My wife and I are naturalized US citizens. We received our US citizenship in 2011/2012. We are originally from India. I have lived in MN USA since 2001, and have been continuously employed in MN USA since then.

 In June 2018, I went to India for a short trip. I met a lady there, one thing led to another, and she has informed me that she is carrying my child.

I want to raise the child in the USA. She has agreed to deliver the child in India and hand over the child to me, but has refused to come to the US consulate for any paperwork. She has agreed to sign any document giving away the rights to the child.

What is the process that I need to follow to bring the child back to the USA?  What are the pitfalls I need to avoid? What documents are needed from my end? Can the US Consulate deny the child a CRBA and US Passport? Can the US Embassy in India insist that the birth mother appear before them? Who should be listed as the mother in the birth certificate – the birth mother or my wife (who is willing to raise the child)?

so you had an affair, had an illegitimate child, and want to bring it to the US?

 

good grief. your wife is far more forgiving than I would be.

 

Mother will have to sign over for permission for you to have primary/ sole custody and possibly all parental rights. This will involve courts and i imagine, yes, she will have to go to the consulate.

The only way for your wife to be listed as the mother on the birth certificate would be through adoption and the mother signing over all parental rights.

9/15/22 APPROVED! Now to wait for NVC and interview....

Is this a different issue than this from a year ago?
