Timeline

Hi everyone,

 

My petition for the K1 fiancé has now reached USCIS. Anyone knows about how long it takes for them to review it and notified me of why the visa was denied?

Any answers and ideas will be truly appreciated. Thank you

They will not review a returned I-129F. It will sit to expire. This is USCIS policy. I know it may be confusing since the embassy/consulate likely stated that it will be sent back for review, but that is the DOS process, not USCIS policy.

You will likely need a FOIA request to see why it was denied, but a returned petition only occurs when they believe it is not valid (usually not a bona fide relationship, or they think you may already be married).

1/2/18: EAD + AP approved (no website update), 1/5/18: EAD + AP mailed, 1/8/18: EAD + AP approval notice hardcopies received, 1/10/18: EAD + AP received

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

8/15/2017: POE

This case has already expired anyway. it has been more than a year since I filed for my fiance

Im just wondering how long it will take before they reach out to me.

The only response they will send is that the I-129F has expired. It will not include the reasons for the petition being returned, unfortunately.

That's the thing. They didn't tell him anything else than he was not eligible and nothing else. The lady told him USCIS will send him a letter with details of why he was denied. That's why we have been waiting for that letter to come.

He was given a piece of paper stating he was not eligible and that the petition was to be returned to USCIS. That's all

That paper was not label as any type of forms
