Basically this person came over on a employee based visa in 2000. There was a problem with current job and this person said they could not apply for any other job because they did not renew their green card.

They got a green card through their job, or just an employment based visa? If it was a green card then I don't believe that work based Green Cards can be conditional, although I may be wrong. Honestly I'm no expert on work based Green Cards, you're probably better off asking this on a forum more geared towards that.

Again it boils down to was the green card a conditional one or an un-conditional one.

Yes, but under what circumstance would an employment based Green Card holder get a conditional card? The only example I can see is an investment based Green Card.

If caught could they be deported? Is there any responsibility on the employer?

Again it boils down to was the green card a conditional one or an un-conditional one.

If conditional one an the conditions were not lifted then they lost Lawful Permanent Residence status, if it was an un-conditional card then they are still a Lawful Permanent resident and only needs to file for I-90 to renew it.

One more question. What if they never applied for their 10 year green card? Just let the conditional one expire.

Yes, one can get a "work-based" green card. Your employer files an I-140 and once approved, the beneficiary can apply for AOS.

Yes, one can get a "work-based" green card. Your employer files an I-140 and once approved, the beneficiary can apply for AOS.

They aren't. Only marriage-based and investment-based green cards can be conditional.
