K1 DENIED- Whats next?

Timeline

Write letter to UCSIC, asking to withdraw your K1 Petition, they will send you confirmation of your request,   then you can get married and file a CF1 visa.

 

Send it UPS or USPS with required signature so you know they receive it.

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

The CO was not 100% certain that you were not married yet due to the evidence he saw...which I will note is what you submitted. Always be 100% certain that whatever you submit is helpful to your case.

 

The I-129F will be sent back to USCIS where it will sit to expire. there is no reason to wait for this to return...you can marry (anywhere in the world) then file an I-130 to start the CR-1 process. Include a letter with your I-130 packet stating that you want to withdraw the previous I-129F petition  with receipt number WACXXXXXXX.

NO,   withdraw your K1 petition before you get married.  Yes it will sit on a shelf somewhere, but USCIS must close it  or you..

 

Don't include withdraw letter with new CR1 petition.       Must be withdrawn first, or they can refuse your CR1 petition, saw this happen twice already with people.

Can you provide the references to those 2 cases? This has been a regular process for years and years for people who marry mid-process, let alone after a refusal.

Visa Journey is not the only immigration help website.

For the sake to let your mind at ease 

  • Write a letter and get it notarized right (you can go to your bank to do it  - as long as it is in English and there is a signature on it, they will do it for your)
  • Wait until you get the official acknowledgement that your case gets withdrawn
  • File I-130

To be honest, if you are filling for the same person, a letter of explanation (plus the copy of reject K-1 letter you had) accompanied with I-130 should be fine.

 

This is my story of filing K-1, I-129F several years ago.  We did not register for marriage but we took wedding photo album, having wedding ceremony (It was a wedding ceremony with a clearly written in our native language), had like 600 guests. In my petition, I wrote a letter citing the Vietnamese Marriage and Vietnamese Law ( I believe it was 2000) that it would be considered legally marriage if and only if we registered and obtained marriage certificate. We did not that why we filed K-1 instead of CR-1. No, issue :).

I understand the frustration but some people can't even do a simple search on here about engagement parties and K1 denials. So I don't expect people to go on google to ask that question.

Edit. I found out the beneficiary is from India so I will elaborate a little more. When we mean engagement ceremony photos which then deem the couple as being (traditionally married) in the CO's eyes. This is usually done when people want to do a traditional Hindu engagement which in the CO's eyes and in the culture's eyes as the couple is then traditionally married.

We had a case a couple months ago of a couple in Nepal who had a Traditional Hindu ceremony celebrating their engagement and then brought those to the K1 interview to show a  genuine relationship between them for the CO and were promptly denied for having a Traditional Wedding Ceremony. 

 

Simple engagement ring photos should not go bad for you at all.

Thanks....n yeah v jus pasted two pics of our hands wearing a same kind of couple ring...country was thiland though...she proposed me on our vacation thr...amd also same sex marriage is not valid in India as well as thailand...i hope thy will b knowing this

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
