Hi everyone, I live in San Diego, CA, and I have a question related to Form I-751: 
Few day ago, I already sent my package for filing form I-751, and I just realized that my joint tax returns of 2016 and 2017 (form 1040 and form 540) are client copies, and they are unsigned. Also, I read that there were some update for immigration policy after the 9/11/18 that USCIS now has the power to deny petitions lacking initial evidence, and It makes me worry 

The evidences that I have in the package are: 

● Form I-751 signed by Petitioner and Spouse
● Copy of Petitioner Permanent Resident Card 
● Copy of my Driver License 
● Copy of Spouse’s Certificate of Naturalization  
● Copy of Spouse’s Passport 
● Marriage Certificate 
● Affidavit of 2 Friends
● Copy of Tax Documents of 2017 and 2016 (Form 1040 + 540)
● Bank Statements (3 earliest months and 3 latest months)
● Joint Vehicle Certification of Title
● Joint Car Insurances
● Rental Contract and Receipts
● Proof of Electricity Bills and Internet Bill
● Proof of Phone Bills
● Photo taken with friends and family members

My question is: Are these evidences enough? Should I order the IRS Tax Transcripts, the form 1040 and form 540 with signature and resend to USCIS as soon as I can? or the unsigned client copies of form 1040 and form 540 are fine for me?

You either need to submit a copy of the tax return WITH all the w2s and 1099s (and any other form like that you used for your taxes) OR a transcript. They also will probably ask you for ALL of your bank statements. Yes, its a big stack of paper, but they want to see it all not just a few months sample. 

 

You should not worry about your packet being rejected due to the new policy. Its for people that send obvious incomplete packets to get it processing since it takes so long. If you sent just the 751 form and your ID then yeah maybe they'd send it back, but you submitted a decent amount of proof so it should be accepted and when reviewed in detail they will send the RFE. So get your papers ready. You can also use the RFE opportunity to add stuff to your packet. Check out other threads for ideas of what else you can add.

RFE - is request for evidence. So they're asking for more evidence to be mailed. For interview should be a separate notice.
