:D Hello to all!

I have a case scenario that a friend of my needs help with. She came here from Peru about 17 years ago, got married with a permanent resident and filed for adjustment of status...that never work out as before they got their interview they got separated...right now she is legally divorced, has a ss no. and expired EAD...nothing else...recently she got engaged with a wonderful man who is a citizen but who is still in the process of finalization of his divorce. However, would like to get her legalized here as soon as it is possible...is k1 applicable in this case? I have my doubts as we are talking about a visa process and not an adjustment of status...any ideas? suggestions? Thank you for all your help thru my process... :yes:

Without commenting on your friend's legal status, which seems a bit unclear to me, perhaps it is possible for her to marry the guy after his divorce and then file directly for adjustment of status. I have heard of this being done.

Can she not still go through with her adjustment to permanent resident anyway? It sounds like she had a bona fide relationship that didn't work out. Did she ever get her interview notice?

That said, perhaps she is best advised to seek legal opinion from an immigration attorney first.

Thank you for your response...as for her previous marriage...she actually went to the interview by herself since the guy she married turned out to be a real jerk...her legal status is right now in limbo...so we will see what will happen next...thank you and I also think that her best bet is to seek professional assistance of an immigration attorney
