I just got an email from the CIS Ombudsman that my K-1 case has had a determination and I should hear in 15 days.  I am just surprised that 5 months after being denied they are still looking at the case.  Should I be concerned that it may impact the CR-1?  I don't expect the CR-1 to get looked at for many months but the fact it seems the K-1 seems to be open still scares me very much.  We got the notice of refusal in early April but never saw an official NOID.  It was just delivered with the Passports when they were returned.

There is no NOIR or NOID or anything with refused/denied K-1s. The petition is left to expire; but there have been cases where someone was denied, then say 2 years later goes for a K-1 interview for another petitioner and has been denied because the original petition is somehow still active.

You should write in immediately to get the petition withdrawn/canceled for the I-129f just in case so as not to cause complications later.

Nope.  Don't be concerned.    Just let it turn to dust.    Don't have to do anything with it ..   for sure don't need to write a letter to withdraw the petition ---  IT was denied!

You can call USCIS, they have a contact number

Ask them, they seem to be pretty up to date on what you need to do

Yes they are!  I sent the request to the Ombudsman in late February and here they are just a mere 7 months later and they have already responded.  🤣

I just got my official letter from USCIS.  It says that my approved petition was returned to USCIS from NVC and that as of the date of the letter the petition has expired.  That is good news since part of me was worried that the K-1 would come back to bite me.  Now it is full steam ahead with the CR-1!

The case is dead. Nothing more that he needs to do. No need to call anyone.

Just keep all your correspondence to and from any Government entity. This would be a good time to get a cloud account and scan everything to it for safe keeping along with the "paper" copies which will remain with you at home. DropBox and Google Drive are two that I have used. They offer 1T for free.

I suspect you will get at least one more letter in the future stating the same thing. Either from NVC or US Embassy in Manila

Just when you think you have TDS eradicate,  a new case shows up.
