Hi everyone!

 

I am a new member to this site and I am currently waiting for our NOA2 and I have a couple of questions.

 

Uk Police Certificate - I got my certificate a bit early.  Its dated 27th February and our NOA1 is only dated 13th April so it looks like at best I will be having my K1 interview late December. I know it is valid for 12 months with the London US embassy but I was wondering if I need to have the document be valid for AOS after we have got married?  Do I need to have a police certificate thats less than 1 year old when we file that too?

 

Affidavit of support - When we do the embassy interview and also for AOS - My fiancé (petitioner) is currently pregnant and due 6th January and she has had to stop working and move state to be with her parents to support her through difficult pregnancy. Her last W2 tax return shows way over the 125% required and her earnings so far in 2018 are about $5,000 below the required amount.  Is it ok for us to bridge the gap by having 5 times that difference in the bank for both the K1 visa interview and the AOS after the marriage? If she is temporarily unemployed until after the baby is born how would that affect the visa application?

 

Also I just returned from the US after staying 6 months to the day on my B2 visitors visa.  I am currently living with parents back in the UK while we are waiting for the visa and I don't have a job.  What would be my chances of trying to return to the US for the birth of my child if the visa hasn't come through then?

It's not last year's income. They want to know current income. If unemployed, her income is zero.

Example--

if she got a raise to $2000 a month, then $2000x12 = current income $24,000 even though last year's tax return doesn't show that much.

Not working at time of application or interview $0 a month. $0x12= $0 current income even though last year's return was sufficient.

I would not go again on a six-month plan. While not specifically prohibited, it's a bit much. The officer on duty gets to decide your fate. There's no way to predict his mood when an unemployed Brit who has already spent six months in the US shows up.

I forgot to mention that she has earnings so far this year of just over $15,000 and she is also receiving just over $2,000 per month from her personal disability and mortgage insurance policies that have agreed to payout while she is having the pregnancy problems, Would this count as income? If so I think she is ok for the levels required?

Have you looked at the form?

 

I am currently

Employed as a __________________

Name of employer________________________

 

Is she employed? Can she give an employer name and address? Will the employer write a letter saying she is a full time employee earning $xxxxx.xx per year?  

Fill out the form and see how it looks. Fill in her assets...savings, stocks, real estate.

Get a letter from the disability insurance saying she will receive $xxxxx and for how long. 

Then evaluate how a stranger in London will determine that you will be supported in 2019 because there is a reliable stream of income going forward. Or get her parents to fill out the I-134 for you. London will accept that instead of one from her.
