Hello,  I have a question that I'm not able to find clear answers on so I'm wondering if anyone may know something.

 

My fiance works as a researcher earning his PhD in the Netherlands.  We're doing the K1 visa process and he's almost got his interview to move here.  His boss was so amazing and offered my fiance a job in Minnesota at a university lab continuing his PhD with his boss in the Netherlands, while under the supervision of a colleague in Minnesota.  We explained to his boss that he legally won't be able to work until the EAD is approved, which take a few months.  He's willing to work with us, but we're trying to get a few things straight.

 

Are unpaid internships legal?  My fiance is willing to work in the university lab unpaid, to continue his PhD, without a delay while waiting for work authorization.

Also, since he technically would be getting paid out of the Netherlands (his salary will still be coming from his boss at the Erasmus Univ.) -- does he even need EAD for this?

 

We're so confused about how this whole thing will work and we're hoping someone may be able to shed some light.... We want to follow the rules and not break any immigration laws.

Nope. Not allowed. Gotta wait for ead in hand. After filing for aos, have his future boss write him a job offer letter and you can apply for an ead expedite. It’s the only way. 

Thanks for the reply!  Does this also go for an unpaid internship option I mentioned?
