Form I130 - Spouse Beneficiary Passport Information

US citizen filling for spouse in India.

 

My spouse has never visited the USA but DOES have a valid Indian passport.

 

Should I still enter her passport number for question 47 even though it seems like the question only pertains if the spouse has visited the US?

You do not need to provide one at this point.  However, she will need one soon so just apply for it now.

She already has an Indian passport. Is that what she'll need in the future?

If she already has one, then it is good. I-130, do not to include her passport# if she has never entered US.

That you have asked this question could indicate your skill at English is insufficient to complete the process reliably.  You must be able to read carefully, interpret literally, and answer accurately.  "IF the beneficiary IS currently in the United States, Complete Items Number 46a - 46d."  The passport number is asked for in item 47 and other information in items 48 - 50.  You DO complete items 47 - 50.  However, NOT doing so is such a common error, it tends to be overlooked, particularly if the answer to item 45 is "NO".

Facts are cheap...knowing how to use them is precious...

That is precisely why I asked. The literal interpretation makes it seem like it SHOULD be listed. I was just looking for clarification.

Are you sure on this? Reading the I130A Instructions pdf, Section 7 makes it seem like this section only needs to be filled out if the person traveled to the US.

What I'm sure of is that it is OK to complete 47 to 50 even if the beneficiary has never been to the US.  The instructions are not consistent with the form itself.

 

I think you mean the I-130 instructions, not I-130a.

I think you mean the I-130 instructions, not I-130a.

And yes, I did mean I-130 instructions.
