Hello everyone,

 

I just got a email from USCIS APP that said that they have received my RFE. Does anyone know about how long it can take before they can make a decision on my case? The reason why I got RFE was a simple stupid mistake that my lawyer has made. 3 questions were not answered. They were 1. Do you have any children under the age of 18. 2. Does your beneficiary have any children. 3. Has your beneficiary ever been to the United States before. The answer to all those questions were no. I'm finding out recently that I should of just done the process alone instead of hiring a immigration lawyer. I hired a immigration lawyer so that mistakes like this would of not happened. But realizing that no one else will care about their case other than the people who are filing it.

 

Another thing does anyone know which dates are available currently in Vietnam for a k1 visa interview?  Only asking because I'm going to be visiting my fiancee this month towards the end and was hoping and wondering if its possible that we can just do the interview while I'm there. I'm planning on staying for 3 weeks currently. But if we are able to do the interview i will extend the trip so that I will be able to attend the interview with her. Any info would be greatly appreciated.

It has been taking 2 to 4 weeks to get a petition approval after they get the response to the RFE.  You are then two to three months away from a visa interview, when the petition is approved.

Facts are cheap...knowing how to use them is precious...

You have to pick a date from the online calendar. Check it often because people cancel and dates open up - that's how we got a quick interview. I was able to grab a flight and go to the interview. You must attend the interview, otherwise there is a greater chance of denial. I've spent a lot of time in Vietnam, researched visa approvals/denials, and know a lot of American-Vietnamese couples. The likelihood of approval definitely rises with the American attending the interview. I'm convinced it helped us. Plus, the Saigon consulate is a crazy place and worthy of a visit. Good luck!

  • You can schedule the interview date for K-1. Just keep checking if there is a slot can fit your timing. 
  • Your presence at the interview definitely will help but I am not sure it is a must:
    • My ex interviewed for K-1 several years ago without me being there and got approved.  I did a lot of business travels in Asia back then so I was able to visit her like 15 times per year. Interview date did not fit into my schedule.
    • My uncle's wife got her interview without my uncle and got approved. He met her twice before petitioning K-1 visa.
