Hello, 

I am hoping this is in the right thread! Not sure who is online right now, but I have an appointment at my local Field Office tomorrow morning to see about my AP. I spoke to USCIS over the phone at first and, basically something has come up back home in which one of my parents would need some support for a while, due to her partner up and leaving her barely getting by with my younger brother. The USCIS told me I should make an appointment at my local Field Office to see about getting my Travel permit extended to a year, but didn't specify how long my current AP is. How long does the AP last for and is it possible for me to work while back in the UK, provided I have sorted everything out with USCIS first?

Ah ok, I wasn't sure. This situation is a nightmare  because I'm not sure how long I need to be back, but I was figuring just a couple of months, just less of a year and want to make sure I don't effect my visa. I am at that stage where we are awaiting for a Green Card interview to be scheduled so the stuff back home could not come at a worse time!

If you leave without AP, you’ll abandon the AOS and you’ll have to apply for an immigrant visa from abroad. Leaving with AP for that long is tricky because you run the risk of missing your AOS interview, or getting a denial and then you can’t come back because your AP will be at risk.

Shall I just explain the situation to them tomorrow at the Field Office about back home and see what they say? I do have my AP that came with my EAD around the 2nd of August. I definitely am not going anywhere right now until I have spoken to them as I am do not wish to affect my visa.

I basically wanted to go back and help support mum for a bit back home. I think I got the runaround when I called USCIS because I told them the home situation and they said about the possibility of me extending my travel permit and to make an appointment with my local Field Office. Even an immigration officer told me that who I was put through to from USCIS. But I do have a current AP.

If I go on my current AP, I would need to be sure to be back before it runs out? Trouble is I'm probably risking it as I don't know when they will schedule the interview and how it will be returning on my AP.

If you just got your AP in August there is no way you’ll get an extension. You have almost a year in your AP. You said so you wanna be gone for a couple of months. That AP should be plenty. It also doesn’t look good that you just filed for AOS and you want to go back to your country for whatever reason, USCIS doesn’t care what your reason is. You’re supposed to be making residence here. Not go back to you country right after getting AP.

I definitely got the runaround when I called USCIS and spoke to them, as well as when I spoke to an Immigration Officer. I will cancel the appointment for tomorrow. What I was told was, well they said sorry to hear of the situation back home and to make an appointment with my local Field Office to plead my case. But considering that it could up things, stuff back home will have to wait.

Missing any of your upcoming appointments - biometrics, interview could put your entire application at risk. Even postponing will delay your process. USCIS won't make special circumstances on your case because your mother had a breakup and is struggling financially. To adjust status, you will also need to be residing in the US. Moving back to the UK and starting to work compromises that, as well as your ability to show that you and your spouse are living together as a married couple.

Yeah, I have just been discussing with my husband about it because it has not been an easy time, well personally for me and of course back home. And I know that will not be cared about. I am cancelling the appointment for tomorrow, save wasting people's time and to save my AOS application from being ruined.

You can work in the US with a valid EAD and send money to your mom in UK and Skype a lot. That's much safer :) With the GC, when you get it, you can stay out of the US for 6 mo out of a year but even with that it is not recommended that you get a job in the old country, unless the employer is US-based and is sending you there for a project.

04/15/2016 EAD/AP combo card received in mail.

12/23/2016 USCIS suddenly changes several forms, invalidating my EAD/AP renewal package (not yet sent)
12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)
12/04/2017 RFE received in mail
12/07/2017 repeated medical exam for I-485
12/08/2017 Attorney receives documents for responding to I-485 RFE
12/21/2017 Response to RFE received by USCIS 
02/09/2018 I-485 approval (text, email) :)
02/08/2018 I-485 approval notice issued (the "welcome letter") - I'm LPR now
02/16/2018 Green card received
 
11/14/2022 Filed N-400 online; receipt and biometrics reuse form received online
03/07/2023 N-400 Interview scheduled 
04/xx/2023 N-400 approved, same-day Oath ceremony completed. I'm a US citizen.
