I received an RFE letter on our I601 waiver recently. They are requesting additional documents to proof hardship and notice that he was ineligible for  a Visa. He has not been rejected a visa, but the FOYA says he is not eligible for a I212. Does he really have to be requested by an officer in Juarez to get the waivers before we request them????? please advise, thank you!

He must interview for the visa, be otherwise eligible for the visa, then be refused due to the inadmissibility. An I-601 cannot be filed beforehand.

 

Edit: Also, what process are you going through? This is posted in the ROC forum, but it sounds like he needs a visa. What visa?
