As far as the question itself goes: if the baby is born in the US, the baby will be born a US citizen. Also, once the baby turns 21, he or she can file for an immigrant visa for the mother (as long as that option still exists then). (Assuming that she pays for all medical costs and does not overstay.)

Thank you. Yes,she will pay for everything.

So she just conveniently “has to get away” in time for the baby to be born. Yeah, no one can see through that flimsy excuse.

Waving a credit card won’t be good enough for CBP. Sorry to burst your bubble. She will need to have proper proof she can pay.

Worst case is not actually a couple of hundred thousand dollars, worst case is complications that means the baby can’t travel but she will have to leave because her visa stay is up. One day overstay = cancelled visa and about zero chance of a new one.

As i mentioned earlier, she has proper documentation that shows her medical records as well as the payments made to her medical provider here. She has been coming here in the US for medical purpose even before she got married.

She has a big business, chains of restaurants in Philippines, but tries to get away from her ex with his baby, and give birth in the US, why not Philippines?

Your story doesn’t make any sense.

She has other friends of course, but again she considers me family. She knows i can give her full support when she give birth to  the baby. Since I am here in the US, she wants to come here.

We are not renting. And she is planning to rent a townhouse to stay in Fairfax, Northern Virginia.

How is someone on a tourist visa going to get a short term lease on anything?   She has no credit rating. Is she really going to take a newborn into the type of property that would rent to someone with her plan?

You are really gullible to believe that you are not going to get stuck with bills - especially if you cosign for anything.

If she has the money and the CBP let her in she can have the baby in the USA.  Birth tourism is a thing in the USA too.  I understand wanting to be with close friends or family during the birth of a child when you are a single parent.  Best wishes to her.

The baby has 2 parents.  She CHOOSES to live apart from the baby's father.

You will be financially responsible for her bills.  You are going to compromise everything you and he worked for. I hope he has more sense than to sign for anything !!!!!!

NovaDC,

Do you not see what the potential issues are to YOUR future?

That's the part that i  dont want to disclose in this forum since that's her personal choice. All i was asking in the first place was the legality of giving birth here with a tourist visa.

I don't get it. The US is literally the MOST EXPENSIVE place in the world to give birth. There are so many other better options in other countries with affordable prices and the same, if not better, care. Why would someone choose to come to the US to give birth from another country?

To get us citizenship for the child, either in the belief that it will get the parents an immediate immigration benefit or to wait it out until the child is 21 and pressure them to file for the parents.

This, only reason.
