K1 denial because of age

I think if you want better odds in Morocco one gets married.  You still need face time and more face time.   You can not appeal a K1 denial.  You can appeal a Spousal denial. 

 

 I think people here don't ask the right questions.   What can I do to make this a better application and get approved faster? 

 

When I met my wife she was 23 and I was 50.  Say what you want. We are still in love and together.  We had other red flags but we put together an package that impressed my USCIS DCF interviewer and was commented on by the CO. We have been together since spring of 2017,  traveled in South East Asia for my work and now lived in two countries together. 

 

We got married in Hong Kong this March. We were able to take advantage of every legal rule allowed and every advantage technology gifted us. I have Dual residency with Mexico.  We moved there so we could do a Direct Consular Filing in Mexico.   That saved us all of the USCIS and NVC time. NOA1 to NOA2 was 1 Business day. When the consulate contacted us in August the soonest interview date was December 27th.  We took that.  We we verry happy.  I checked a few times every day for cancellations and after 2 weeks got her an appointment on September 25th. I wanted to be with her for medical and biometric so we left that appointment where it was so I didn't have to move business travel around.  I had a trip to Seattle and Vancouver the thursday after the interview.  We took 2 flights and I drove 10 hours to get her to our Mexican house and me back to Arizona to travel more.  I did my work and came back to mexico to take her to get her visa.   

From NOA1 to Visa-In-Hand was 102 days.

 

Even before getting married we did things together. I stayed with her at a conference in Cebu.  She accompanied my on trips to Malaysia, Nepal and Hong Kong.    After we got married,In Manilla, she came to see me speak and I helped her find a boarding house for a few months while we worked on Visas and Paperwork. I had to leave to go work a project.  She took driving lessons.  She got an international driving permit. When she needed me there for her Mexican immigration appointment I met her in Hong Kong.  We took care of that and I went back to Manila with here to pack her things. A few days later I was picking her up in Tijuana to drive to Puerto Penasco where we would live until the US visa interview.

 

I lost a lot of work opportunities while this was going on.  Frankly it is going to be christmas without a lot of monetary gifts.   

But I got the one gift I wanted and she is getting the gift of a lifetime.

 

Remember that being together is what is  supposed to matter most.  Arguing with what shots are needed isn't going make things go quicker. (we all know worldwide you are getting the shots they tell you.) Follow the instructions literally.  Be smart with the questions you ask  - Most answers can be found in Google. Remember those that answers are not lawyers but being sincere  given by people that have no financial interest. Responders are telling you either what they did or that they think.  And lastly if someone is being a bully report them.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Well as long as they will let us show proof we were together 5 months this year and I'll be with him for a month when he has his interview so we will have alot of time together and we also had my kids there with us for the summer and I can still have babies

Age alone is never a cause for a refusal. But it can be a factor.

Yes, Morocco denies a lot of K-1 applicants. The data from DOS backs this. Anecdotal evidence is not reliable...some people say it was easy and lots of approvals while others say everybody was denied the day they were there. Both statements might be true, but neither is accurate as one experience does not make a full picture. Data, on the other hand, tells a bigger story.


No, don't read too much into approval/refusal statistics as it is always about the individual's case. A strong case will get through it. A poor case will not. Be sure to focus on one's own case and making it as strong as possible.

Don't listen to "Morocco denies lotta K1 applicants..." comments. There were around 30 interviewees on the date I had my interview, only 2 who got denied and by very obvious reasons. I am 9 years younger than my fiance, but they could easily tell that it is a legitimate relationship. Also, there is one question that can be a trap. What do you like about your fiance/wife? If you focus only on the physical things you like about her, you're done, my friend. Because I would deny you if you tell me that you like her beauty and pause for 5 seconds. Think of intellectual things, her thinking...things that show that you are interested in things other than beauty.

We have a very strong case but only if the co let's us show our proof that me and the kids stayed 90 days with him in total I stayed a little ove 4 months with him this year and I will be there for his interview so if they let him show this I think we will be good

There is a 16 years age difference between us this is the only red flag we have we share the same religion he speaks English I cook alot of his kind of food I can have babies we both are very well educated I cant think of any other red flags

Totally different scenario and of very little help to the original person. Because you went through DCF you are obviously already married and had been living together for some time. That’s quite different from a K-1 applicant with one visit. The Mexico embassy has a much higher approval rate than Casablanca. And it’s almost a given that Filipinos wives will be a generation or more younger than their husbands.  

 

FWIW my experience through the London embassy was also a breeze. But a spouse from the UK will always have an easier ride through this than a fiancé from Morocco. It’s just how it is.

The one and only real red flag in these types of situations is the child bearing issue, I have seen this time and time again. The way that they look at it is, he Muslim, what's the cultural norm in the country where the interview is being held? In the case of Morocco, children and family are number #1, if they see a man dating an older woman who can not have kids, this raises the flag really high. I don't mean to sound offensive at all but I am a realist, I too have an age difference but still able to have children, I am not so concerned with it and neither should you.

FWIW my experience through the London embassy was also a breeze. But a spouse from the UK will always have an easier ride through this than a fiancé from Morocco. It’s just how it is. 

If I knew this before I should have moved my fiance to Mexico too I'm Mexican American I think this is good advice . He's having his interview in January 28
