K1 visa filing while fiance is visiting me

Answer no. As she is not here permanently. She’s only visiting.

IN REGARDS TO WHICH DATE TO USE!!!!!!!!!!!!!!!!!!

noa1 date is actually they date on ur hard copy. Sadly if u reach the magical 220 day u must wait till 225 to contact Uscis. They use what the new site says. Even if ur paper says X date. 

They added 5 days onto everyone’s accepted on NOA1

I disagree. The question is not wether they are in the US permanently, it asks if they are currently there. If you complete the form while they are in the US, you just answer yes and answer the next few questions about arrival, travel document, etc. Answering no would technically be lying, and I would not risk that.

I agree with this response. In addition, OP, make sure you make it very clear in your cover letter that your fiance is currently visiting you in the US while you fill out the form, and that she intends to return to her home country for [work, studies, etc].

02/07/2019: Biometrics appointment

02/11/2019: RFIE response mailed

08/08/2019: EAD/AP approved

08/14/2019: AOS Interview & Combo card arrived in mail

08/21/2019: Green Card arrived in mail

here is the correct answer.

 

Questions 37-38: You likely do not need to fill out this question, assuming that the immigrant is currently not in the United States. (If the immigrant is visiting, remember that he or she will need to return home in order to complete the fiance visa application process—and must do so in a timely manner.)
