I-134 for K1 (assets & debts)

Timeline

We just received our NOA2 and I'm completing the Affidavit for Support.  My question is due to my divorce, I took on a lot of debt.  So for question 8a & 8b, is this just strictly real estate?  Do I need to include my credit card debts and loans in this section?  If so, would it effect our K1 Visa approval, if say my home is worth 200K and debt is about 200K as well (including mortgage).  I have retirement 401k and an IRA as well as assets?  Should I be listing that in stocks and bonds portion (question 6)?  I should note that I do make well above the poverty level.

Not sure how strict Vietnam is with all this; but are you using income as primary proof of sponsorship or assets/savings?

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Timeline

my income was well over the needed limits so i left this part blank / i didn't need to use assests

and no where on the form does it require statements of credit card debt

if u owe IRS it will be an issue

I'm assuming income.  As I stated, I do make over the poverty level but I'm just curious/worried that my current debt is high.  So my home is worth 200k but I still owe about 180K and have 20k in cc and loans debt.

So did you just include mortgage value and what you owed on your home?

Like the other user said, that's only reason I asked as I never listed my 401k value, or that I owed money like on a car payment.... if you meet income wise really don't think you need to say anything. Think it is kind of assumed that people have bills. Plus a loan/mortgage isn't really a debt. I mean it is in a way; but like I pay rent, didn't mention that to them as believe it is just naturally assumed. So long as you meet the income requirements, think you should be fine without stressing over these things. Think only thing that could be potentially needing to be listed is like legal obligations such as child support and stuff.

As Kris said "u do not need to fill out this section unless u are using assests as income is not enough"

leave it blank

i also left it blank and i own house and rental property outright

Correct, he could write in case he wants to fully disclose assets and debts but like others said, if his income (considering his household) meets the requirement, there is no need to disclose additional financial information.

Exactly!  To OP:  You only fill this out if you need to use your assets to meet income levels. In your case, you do not need to use assets. So you would leave it blank.

In case you decide to disclose this information, it will not be a factor to impact the ability of petition for your significant one.   Based on personal experiences, U.S. Consulate Ho Chi Minh City is not really picky about Affidavit of Support as long as it meets requirements but the evidences to show bona fide relationship (face-time is the primary one).

Yes, that's right. They don't care, so long as you have a good and steady income. I would put something in 8a and 8b. Leaving things blank is asking for RFE or problems. You'll be OK.

I did not list my real estate or retirement.   If your income is 125% above the poverty line just use that as the other information will  just complicate things more.
