could anyone from members give expert advise what to do next, or what went wrong

 

Progress: 

1) immediately submitted all requested documents in december through preferred courier of consulate

2) though consulate didn't acknowledged submitted documents, nor requested more documents, but then dates moved few times throughout year with status Ready

3) last status changed to below on July 31, 2018 and quickly inquired with IV section on below update

4) IV section response is below:

Our records indicate that the visa application for this immigrant visa case is still pending under administrative processing. Unfortunately, it is not possible for us to predict how long this processing may take. The wait could possibly be quite lengthy. However, please rest assured that as soon as this processing is finished, we will contact the applicant using the contact information he/she has provided on his/her application. Thank you for your kind understanding. 

 

If the applicant has not heard from our office after six months, please contact our office again using the web-based email form available on the website of the American Embassy.

5) didn't received any passports, letter or formal email from consulate as reason of Refused and what next to do (to avert refusal). medical is also expired

 

please guide.

We can not tell u what went wrong 

we can only say possibilities

could be the name showed up on a list (too many names in  that area are the same)

could be the person did not display enough information about u and your personal life

could be travel to a terrorists training country set up a red flag

we can say hwat happens next

case will be returned to the US and in about 6 months u will receive a NOIR or NOID 

letter will tell u the issues the embassy had with interview

you will be instructed to either give expalnations and provide proof or appeal according to NOIR or NOID

F4 petition 

Priority 12/19/2003

interview Aug 2017 

11/15/2017 DNA test beneficiary & dependent 

sent new one past Monday 09/10/2018

now ceac has beneficiary also as AP 

Medical is expired as well by now it’s been a year 

have sent total of 3 Affadavit’s each was denied because of income & fact joint sponsors didn’t let me no they had filled someone else’s 

no luck finding another joint sponsor 

meanwhile Son of beneficiary was in AP 

ceac checker said refused for beneficiary (needed a joint sponsor)

now it says AP as well for Beneficiary.

SOunds like you are still in AP.

have you seen enclosed 221(g) letter. two inks (red and black) used along with ticked and crossed items (too confusing) so what need to send.

uh, but how to know

 

- could be the person did not display enough information about u and your personal life

like what? although have very limited social media interactions

 

- could be travel to a terrorists training country set up a red flag

like what? though never traveled to restricted area ever 😕

 

- case will be returned to the US and in about 6 months u will receive a NOIR or NOID 

 so what need to do before having NOIR or NOID, any idea how long it will take to settle down :( | are you sure!

I agree with above it just sounds like AP.   I would send another inquiry this time I would ask specifically if they can confirm receipt of your documents.   Your status is refused as its refused due to review of pending documents.   I would focus on now making sure they have them if they don't you can resend.   Try not to stress about the refused status.

@silverhawk Please do one more thing and I am sure it's very useful.  Call NVC ask them what is the status of your case. They will tell you if your case sent back to the US (they will not tell you the exact reason for sending back to the US) but at least you will know your case is sent back. This happened to one of my friend Islamabad embassy put my friend to AP for 4 months and the status was Ready at that time later changed to refused and every time when he enquired for his case to Islamabad embassy they told him with the same copy-pasted response you are on AP. Someone suggested him to contact NVC and he did NVC told em that your case is sent back to USCIS for review since the date of his interview but as I have told you consulate keep updating him that you are on AP. Please try this method and I am sure it will help..

@silverhawk Also ask NVC about your missing documents they will tell you that consulate received it or not. Don't waste time with consulate they will only send you copy-pasted message not more than that. They are very slow for example if case sent back to USCIS they will update the case status after many months and keep sending you caned message that you are on AP but if you call NVC they inform you instantly.

Regarding this question as I have told you first call NVC and confirm. You can do nothing in that case except for waiting. You will get a response after 6 months and you will have details of everything why they sent back your case. Then you can respond on their allegations if they satisfy they will reaffirm your case and send back to the consulate for another interview.

I had contacted NVC and they told to contact US Consulate for update. But now i'll do it again and keep posted. thanks to all fellows, you are beacon of hope.

I wouldn't worry about a lawyer now.  Once you find out why it was returned if its something that is difficult for you to overcome then you need to hire a lawyer.

 

If case is returned to USCIS it would take 5 to 12 months or more to get a NOIR you have 30 days to respond and they will make a decision usually in 30 days after they receive your response.   If reaffirmed you would have another interview in about 3 months.  If denied you can file an appeal or (this could depend on your visa category) refile which both could take about the same amount of time.

 

Its important to know details of your interview to pinpoint what may have happened.
