RFE help! Filed Jan 10th, RFE received 09/13

You needed 2 letters. One from each of you, even if they are pretty much identical. It’s really too bad about this RFE and delay for you. It certainly could have been avoided. Good luck!  Also, no translation is needed if he understands English.

I always believe that whatever the rfe is for should be provided. I think it depends on the officer dealing with the petition that a rfe will be given. I was given a rfe to provide a document where as a friend of mine who did her petition a few weeks before was not asked for this document.

And yes, always 2 intent to marry letters.

One from the beneficiary and one from the petitioner, preferably with each of you mentioning the other person's name, like "I, Gustavius Horriblus, intend to marry Hairless Wonder within 90 days of him/her arriving in the US". As an example. And then you sign yours and the beneficiary signs his.

Just like most things USCIS, nothing is ever "always."   We wrote a joint letter and got approved with no RFE after 185 days.

Not true, as evidenced by many of us who were approved with one joint letter of intent.

I think you're on to something here.  Otherwise, the instructions would be way more specific and detailed.

You might not have written it the way OP did either. Her letter showed clearly that she was the one writing it, not both of them. "I am the petitioner, my fiance is the beneficiary".. I think if you're trying to atempt only sending one letter of intent it needs to look as if both wrote it.

It seems to me, the determining factor is the Officer reviewing the case 🤷🏽‍♀️ I don’t think there’s a right or wrong way. I know this much, I read the instructions carefully and it doesn’t say two or one is required. They should be more specific so we can avoid delays.

To the officer at USCIS you were clearly the one writing the letter of intent though. It even started out with "I am the petitioner, my alien fiance is the beneficiary", so to them it was specifically from you, written by you. They wanted him to be in on it more than just a signature.

This was as as close as I could come to indicate that both petitioner and beneficiary would write a letter of intent. I really think once you send in both letters you will be fine. Good luck!

Either way, even if a few people get approved with just one letter of intent it's always a safer bet to make one each, two separate ones.

 

It's unfortunate you received an RFE, but I'm glad for your sake that it was an easy RFE, an easy fix. There are way worse RFEs out there.

Depends upon the adjudicating officer. There are others who are considerate. Make 2 letters of intent to marry. One for you and one for him. Date it and sign it. Have him scanned his and send to you. 

 

That will be the safest thing to do to respond to your RFE.
