RFE HELP!! received RFE in the mail today. Requesting intent to marry from Beneficiary 🤷🏽‍♀️ isn’t my letter good enough? He signed the letter. Or did we need two separate intent to marry statements? He’s from Cuba, do they expect the letter in Spanish and then translated in English because he understands English... Also, since filing on January 10th, 2018 I’ve visited twice and heading out there next week, should I submit evidence of additional trips? Thanks in advance! — feeling confused.

You cansubmit more if you want to, just don't go overboard.

 

And yes, always 2 intent to marry letters.

One from the beneficiary and one from the petitioner, preferably with each of you mentioning the other person's name, like "I, Gustavius Horriblus, intend to marry Hairless Wonder within 90 days of him/her arriving in the US". As an example. And then you sign yours and the beneficiary signs his.

I would do one each tbh, and make them very simple. At least this way they will have one from you and one from him with new dates on them, showing you still intend to marry each other. 😄

I have to disagree. You absolutley do not need two letters of intent. In fact, mine is exactly the same as yours and I was approved yesterday (they had no issues with one). @Hazelsky07 , I believe they want a new one because it has been over 6 months since you signed the original LOI. Why was it signed in November, yet you filed in January?

 

If having individual Letters of Intent has become a new thing then I apologize. However, to my knowlege you still only need one but two cannot hurt you.

That's just my two cents. I agree, lose the last paragraph. It feels cumbersome :D

Letters of intent to marry were never "required" to begin with, but having 1 from each individual has been a proven method to avoid RFEs like the above. As one can see, sometimes it results in an RFE and sometimes it does not. Sending both avoids the possible issue.

@geowrian If the date was a problem they would be asking for my signature as well. The reason for the November date was the last time I saw him in person before submitting the application so he signed it in November. Cuba is behind when it comes to technology. WiFi, scanning, printing, emails are not so available. WiFi sucks. Sometimes it’s down for hours, days... we will try this weekend to have him send the letter if not I’ll be there next week. I read one letter of intent was fine, maybe it depends on the officer reviewing the case. At this point if they want, DNA I’ll gladly comply.

I doubt the dates were an issue. It is common protocol to request new letters of intent after so long in conjunction with an RFE for something else, but usually not issue an RFE just due to dates unless there is a very significant gap involved.

I'm not sure myself but in my opinion, they ask your fiance to literally state "I (his name)  intent to marry (your name) within 90 days of my arrival in the US."

 

At least that's how I interpret the RFE letter.

(1) To ease your mind: submit 2 letters - it is just one more paper and you will not need to worry if it is okay or not.  If it were me, I would not want to test if 1 or  2 is fine with USCIS.

 

(2) Write a very simple statement but clearly indicate your intent

 

(3) Additional evidence is not needed, they are only looking to have complete list of required documents.  But again to ease your mind: include some of the most appealing ones. 

 

Petitioning is a long process of waiting and having "heart-attack" moments, to avoid RFE even in case you know you may or may not receive it - chose the one that there is no chance of getting RFE (you may still get RFE but for different reason).

Pretty simple, just each make one as stated above, sign them, he can scan his to you, use current dates, submit to satisfy the RFE. Easy.

 

Also need to submit (or recommended anyways) an "updated" version at the interview also. One from each of you. Again easy.

I was going to mention the same thing about having 2 new ones for the interview. My fiancee took two new updated letters with her, and they took them, but she said the CO didn't look an them, just scanned past them in a 30 second review of the paperwork she brought with her. So can't say for sure if needed, but better safe than sorry.

Wrong. We only submitted one letter. Literally two sentences on a piece of paper signed by the both us with the date. That was it.
