I864A...is it needed?

Sorry if this has been asked before but I could not find a thread to help me.   I'm preparing my sponsor packet for our upcoming interview (its our second interview)

I have a son who attends Penn State but still lives at home.   When I originally filled out a I864 because he was claimed on my taxes I had him fill out a I864a (which at the interview they tossed it to the side as if it wasn't needed).

My question is in 2017 I did not claim him as he made about 40k that year and could support himself.   So am I correct that we do NOT fill out a I864a this time?

I do not need a joint sponsor I'm more than double the poverty line.

Thanks so much!

An I-864A is only needed for a family member living in the same residence who agrees to engage in a contract to support the intending immigrant. There is no requirement for a child to provide one, even if they qualify to file one, especially since your income appears sufficient already.

I-864a is for combining income, OR for a joint filing spouse when the couple are acting as joint sponsor.  Unless you need to combine income with  your son to qualify, he is not involved.  If he is unmarried and under 21, you still count him as part of your household no matter where he lives.

This is discussed often here but more importantly, it is "instructed" in the "instructions" for the I-864, and much easier to find there than to search discussion topics.

Two interviews because our case was refused in December.   We were reaffirmed by USCIS in July.

Thank you!  Yes...InshaAllah!

Thank you!  I've read the instructions many times my mind just kept getting stuck (as Im a disclose all type of person)  between providing total household income and not required to.  Most government agencies want total household income for some reason I just couldn't get past that mentally.

Sometimes even though you think you might know the answers asking out-loud for clarification is helpful.   Since I don't know anyone personally who understands immigration here is the best place to ask.

Thanks again!
