Timeline

hello, what they meant buy you divorce wasnt finished?? cause im in a similar situation my husband got the divorce sentence 3 days before we got married, but the papers was signed like 6 months later... in this case what date they would considerer the end of the divorce, do you know?? thank you

The date that's on the divorce paperwork.

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

I would say it meant his divorce has not been approved/finalized by the government.  In my native country (Vietnam), the date printed on the divorce paper issued by the government is considered the date a divorce is legalized.

i live in california ,

so i got divorced on sept 13 2016, (the judge signed the divorced) but my status would only return to single and final on  march 11 2017

i went ahead and got married in brazil on jan 11 /2107  , 2 months before my divorce to be final, 

so USCIS aproved the ap , nvc fowerd to the Consulate, i paid all the fees, and travel to the interview, to find out that my marriage was invalid for immigrations purposes, and I had to divorce and remaired and file a whole new ap  =/

03.25.2013 (Day 16) - Received Biometrics appointment letter for 04/12/2013 in Santa Rosa , CA

04.08.2013 (Day 30) - Biometrics done in Santa Rosa , CA

05.07.2013 (Day 59) - Status update: Now ready for interview scheduling!

05.12.2013 (Day 64) - Status update: interview scheduled June 12!

05.13.2013 (Day 65) - Received Interview Hardcopy.

05/17/2013 (Day 69) - EAD went in production

05/25/2013 (Day 77) - EAD received

05.12.2013 (Day 93) - interview scheduled!

05.13.2013 (Day 94) - interview approved after separate interview

05.18.2013 (Day 98) - green card arrived

He should have a decree of divorce, or decree absolute, depending on the State.  The divorce decree will state the date the marriage ended. If you married before that date, your husband has committed the crime of bigamy, and YOU TWO are NOT legally married.

The date of your final divorce DECREE.

 

I filed for divorce of my ex in August of 2015 but because my ex would not sign the papers it would drag on to 2 years from the time he was served the papers that  I would get my divorce.  Finally in September of 2016 he signed the papers but decree was not issued by the court until December of 2016.   So even thought I was separated from my spouse since August of 2014 (we split up before i filed) I was not considered divorced until December of 2016 and could not marry until after date of the decree.

Good example.  In some US States, you can have a final divorce decree but are still not "free to marry" until some number of months later.  We recently had a member caught in that mess.  Married (abroad) after the divorce was final but before being "free to marry".  Both parties must show evidence they were "free to marry" at the time of the marriage.  People divorced in some US States are not free to marry on the date their divorce is granted.

 

The OP uses some confusing terms but it is quite possible she/he means to say the divorce was "filed" but not yet finalized when THEIR marriage took place.  THAT....will not work.

Yes... sorry my example is from the state of Pennsylvania.  You are free to marry after the date of the final divorce decree.   In addition if spouse is not in agreement with the divorce it can drag onto 2 years after divorce papers are issued.   

 

OP must check the rules and regulation of the state where the divorce took place.
