As part of its benefits adjudication process and as required by law, the United States Citizenship and Immigration Services (USCIS) conducts background checks on petitioners and applicants who seek certain immigration benefits. These background checks consist of four separate checks against systems within Department of Justice (DOJ), Federal Bureau of Investigation (FBI), and the Department of Homeland Security (DHS). In order to facilitate the collection and transmission of information necessary to complete background check processes, USCIS maintains five information technology electronic systems: the Fingerprint Masthead Notification System (FMNS), the Customer Identity Capture System (CICS), the FD-258 Tracking System - Mainframe (FD-258 MF), the Benefits Biometrics Support System (BBSS), and the Interagency Border Inspection System (IBIS) Manifest. USCIS is conducting this privacy impact assessment (PIA) because FMNS, CICS, FD-258 MF, BBSS, and IBIS Manifest collect, use, and share personally identifiable information (PII). This PIA replaces the previously published USCIS PIA for the "Background Check Service (BCS)" which describes planned background check-related systems that were never implemented. Upon publication of this PIA, the BCS PIA will be retired.

 

 

Also, not completing the I-129f under "have you ever been arrested" requires ALL cases no matter if they are expunge, dismissed or sealed. They want it all!  Failing to do so can render your case denied or an RFE is issued for additional information. This is serious. On VJ member forgot about an arrest in his youth which was dismissed but he answered the question that he had never been arrested. His K-1 application was denied.

Few crimes are a bar for the I-129F. But certain crimes + documentation must be disclosed in accordance with IMBRA requirements, of which the beneficiary is to be informed.

All crimes must still be disclosed on the petition either way...failure to do so can result in a denial.

I think you remember John's case. They got him when his memory lapsed and he answered a question wrong. He took it in stride. Good sport he is.

Wow u really wrote alot... I would have to get my record from the police departments ive been arrested in. Most of my arrests are driving offences few resisting arrests, assualt on officer. No felonies or anything. The assualt on officer was reduced to simple assualt ...

Either way this entire process has stressed me so much that my girl and i have broken up.... I know we will be fine but thats litteraly where im at.. People say dont stress but its impossible when the most important thing in my life is this damn process.

VJ is a double edge sword. The information that is shared is invaluable, but being here you get all those who are processing and think they are owed an approval in a week. :D To which that's just not realistic. Don't set your expectations too high and you won't have far to fall if you get disappointing news or it keeps dragging out. Don't watch :clock: and just :pop:have a cool one while waiting.

Haha i cant take any mind altering substances but i know what u mean .. I cant lose this girl ofcourse my fall back is too save a few years and move there but i would wrather not.

Also, i know it takes along time im not worried about time i can keep going to visit untill the interview is issued... Im just soo0o atressed even though im hiring someone to do the paperwork about things i dont know. Like me having to get background check... Or worries like will he make a mistake and ill get denied.. But i believe he said in 9 years hes never had a visa denied...

  I dont make that much money either about $26k but i have very little bills and oblegations. I just want to know everything about the process so i dont have to stress anymore and can be 100% confident in the process... Even though i cqnt be 100% confident with trump being president....  😕😑

If u have a criminal record u must get documents for court where offense or offenses occurred. It’s also wise to have it certified copy so there is no confusion.

Civil infractions do not need to be disclosed. Ie: driving offenses.

noa1 date is actually they date on ur hard copy. Sadly if u reach the magical 220 day u must wait till 225 to contact Uscis. They use what the new site says. Even if ur paper says X date. 

They added 5 days onto everyone’s accepted on NOA1

Rral offenses street racing arrests etc. Thats what i mean i should get my entire police record right? What do you mean certified

If it’s a criminal infraction which means it wasn’t a misdemeanor or felony then yes u will need it. 

Certified copies means. Someone at the court house is a notary and they sign the papers stating it is legal form and they confirm what’s on there is facts and the truth. Only cost $10 extra to have it done. Well worth the cost instead of possibly haveing to get it done later.

I see many people having success with this. Idk why i over stress it so much.

1 thing that also worries me is the last 3 years i didnt make over 10k each year.. I know it doesnt matter howmuch i made last year it on truly matters what im currently making at the time i file and so on.. But there has to be a reason they want to see 3 years of taxes.

Just an FYI and very minor point but the application states that you must include driving offenses if the fine is over $500.  I live in Maryland and know Virginia has this crazy law that if you are doing over 80MPH in a 65 or 20MPH over the speed limit its reckless driving and a misdeamonor with a $2500 fine.

 

"Criminal Information. Indicate whether you have ever been arrested, cited, charged, indicted, convicted, fined, or imprisoned for breaking or violating any law or ordinance in any country, for any offenses other than those you have already outlined in the previous section. Unless a traffic incident was alcohol- or drug-related or involved a fine of $500 or more, you do not need to provide information on it."

Ive been all those things including imprisoned also have 2 wreckless driving. 

Not indicated tho.... And nothing violant other than punching an officer.

You need to disclose it then. THe standard is not indicted.
