I tried googling but didn't find too much information. Based on my timeline, we are hoping to have our NOA2 after the new year. My question is, normally my employer doesn't mail out W2 forms until the end of January, so would I need to wait for filing the 2018 taxes before sending my fiance the affidavit of support or would they accept the 2017 ones?  Thank you so much!

If using income, supply for 2017 and before. Use recent pay stubs from work, and letter from employer... that should suffice. Obviously can't expect to show anything much from 2018 tax wise while it's still on going......

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Ive been told that thpugh the tax returns are required they dont really matter. What actually matters is what your currently making at the time you file..

Doesmt matter if u made $10 dollars or 1 million dollars last year. Only matters what youre currently making

However, if you are making that $1M, then you should have some assets that can cover the shortage of 125% requirement 😀

Just your the most recently ones (2017-2016...) and pay tubs and employer's salary verification letter to show you are making $X amount, show some assets if you need to.

Your statement of current income will have nothing to do with any tax return.  State what you currently earn when submitting the affidavit.  Send the latest tax return that has been filed.  If the interview is after April 15, 2019, send a copy of the 2018 return to your fiancee to carry to the interview.

It would help to know what consulate the beneficiary will be going through, as there are often different requirements for different embassies. In London for example they prefer tax returns, and really don't care too much as it's a K1. So they will accept anything that proves income requirement, and that there is actually a current income. From me they accepted my fiances last W2, and a letter conforming current employment, but as I said, other consulates may not be as flexible.

He will be going through Seoul, but I wasn't able to find any information specifically about that embassy.

What is "required" in support of an I-134 (or any affidavit of support) will be and always has been at the discretion of the individual Consular Officer, based on the circumstances of the case.  The technical requirement is either one complete most recent tax return OR tax return transcript PLUS evidence of current income.
