Hey! I’m a US citizen from North Carolina but I am currently residing in Australia. I have a fiancée whose Australian and she and I would like to move back to the US together. The easiest way seems to be through a K1 visa but the process is very confusing and I need answers. 

Can I file from Australia? 

Can I file without having a job or bank account in the US? 

Whats a joint sponsor and will I need one because it seems to say I need to make upwards of 17,000 a year to sponsor my fiancée? 

 

Any help or guidance would be amazing! Thank you.

Welcome to the forum.  Have you looked at the Guides (atop any VJ page)?  A lot of good information is there.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes, but it doesn’t answer any of my questions. I’ve also spent a ton of time researching. The governmental websites don’t answer things in an easy format either. Like what types of proof they need and stipulations and financial requirements etc. Thank you for your response.

You need over 125% over poverty line to sponsor anyone. If you don't make this then you need a cosponsor. Co sponsor can be Us citizen or US legal resident who makes enough money. 

 

Even so you are still the main sponsor and you need to file paperwork also. 

 

You never filed taxes? You should provide tax returns if you work - even if its not in the US. 

 

You need to proof domicile or intent to domicile in the US - address, job, bank account, state Id,  driving license, tax returns, - those are just examples. 

 

K1 takes about 10 months to process. 

 

Also all those info can be found in guides or it has been mentioned 10000 times before on this forum.

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Assuming you can't do a direct consular filing (only offered in AU in emergencies), it looks like you'd file from there.   The first thing is to consider your timeline to move to the states,  If you get the visa and don't move, it expires. 

 

You may get better answers from others who've done this, but the income requirements can be tricky if you leave a job and come to the US without one.  A US sponsor is your best option. 

 

I think you'd file all the same info.  I *think* you're required to file US taxes even living abroad.  So if you haven't done that, that is something to look into.  That's the little I know.

So in a nutshell:

 

1. You can file from Australia. 

2. You should have a domicile in US or at least work on reestablish one (bank account, real estate, filing taxes etc.)

3. Joint sponsor is a third party (US citizen and above 18 yrs old) who is willing to sponsor your fiancée becouse you don’t meet financial criteria.

US citizen are required to file US taxes no matter where they live and where they work.
