Expired after reaffirmation

Timeline

Hello VJ family

We were denied in July 2016, we had a noir in april 2018 after a very long wait and received a reaffirmation on July 2018. We contacted the embassy a couple of times to know the next line of action and were told to expect an email, which wasn't received after sometime. We called the embassy today and we were told our case has expired. Is this expiration possible without any notice? Could it be a mistake and if so, is there anything we can do about it?

When were u reaffirmed? Dont.worry about what they said. Once your case is reaffirmed, they will reopen ur application. Check ur status again to verify whether it says expired or AP. Usually once the embassy receives your reaffirmed petition and make data entry the case status is updated to AP

Thank you...we got the reaffirmation letter in July 2018

Chech the ceac status again. If it still says expiring soon or expired, it implies the Embassy has not yet received your reaffirmed petition and might still be at NVC

I want to believe CR1 doesn’t expire except if the case is dropped or ignored. Keep on contacting NVC & the embassy. I hope it gets resolved soonest. I am also expecting a NOIR/Reaffirmation from USCIS. It’s just 3 months gone. Yours took 16months that’s a lot tho. Wishing you the very best

Words mean things.  CR1 is both a visa category and an immigration status.  Both DO indeed "expire"  The visa has an expiration date six months from the medical exam completion and the status expires two years after entering the US.

 

That said, the approval of an I-130 does not expire.  If your I-130 approval is "reaffirmed" then the Consulate will take further action on the case, no matter what you see as a status on any website.  If the Consular IV unit has not yet contacted you, they will.

When the case is reaffirmed that means that case is open,most of the expired cases can be changed to reaffirmed but if it's denied is denied.

you will need a new medical when the embassy receives the case

and the embassy /CO can ask for a new criminal  report  as things do happen in the waiting time
