I am not sure if informal Nikah (verbal offer and acceptance by the boy and the girl) in front of parents and (at least) one other witness would be considered marriage before K-1 entry? This is religiously required before she is able to travel with you alone (for (practicing) Muslims).

Why take the risk?

Oh so many mistakes you’ve made. First rule of K1: never make any plans until after POE. Getting your passport back doesn’t look good. It looks like they predict that you’re gonna be in AP for a long while. Better try and return those tickets. DO NOT, I repeat, DO NOT, have any type of wedding ceremony before arriving in the US. If you get married before entering the US you are voiding your K1. Follow the rules to the dot. It’s not that hard.

Lets see how this works out.  I think the OP has the information now to make informed decisions.  It can perhaps take more time if the girl is not from the same culture and/or religion.

07/27/17 - K1 packet sent at the end of day.

07/31/17 - NOA1

03/22/18 - NOA2

08/28/18 - expected date for medical completion - Sputum test was needed

09/22/18 - anticipated interview date

Confused but why is it a K1 if she isn't going to the US until after the wedding? Or am I reading this wrong as I've had to wait for a CR1 as I got married to my US husband outside the country in the UK, just curious why it's different?

Note: there is such thing as being "too married" in the eye of the customs officials for a K1 so even a religious ceremony is recognized as a type of wedding.

You CANNOT marry and then use the K1 to travel the US. The K1 is meant to bring your fiance(e) over to marry IN THE US. This might be your reason your passport was returned because you are not filing for the proper visa. If you want to marry in his/her country, then you must file the CR-1 visa to bring them over as your spouse.

I thought that, I was totally confused and if she's been honest about that, I think we found the reason for the checks...

I wanted a "party" to celebrate our marriage before I left the UK, but it's risky as it's still a "wedding" and you are "too married" for a K1. I have to wait over a year for aCR1 but would rather wait and have it right than risk it. Maybe that's why they are investigating further. If denied, I'd go for the CR1 if I were you, takes longer but it's the correct way.

Any type of wedding ceremony can still get her denied entry at the border. Do not do this, plan for after the US marriage and make a big deal of it for later.

I thought this, I wanted a party/with my wedding attire but that can be seen as a wedding so we withdrew (I was meant to marry in the US originally but Dad had a heart attack) our K1 and went back and have done it the right way. If her parents want to see her marry, then get married, then apply for the CR1, this is better as she gets her green card when she moves so she can go out to work whilst a K1 you don't have immigrant status.

Thanks all for your reply. We will get married in the US and not back home. I guess I didn't think that through well. We will just postpone the wedding until she is on the states. Thanks.

Good! Then you aren't risking your lives etc..... I'm waiting on a CR1 as we got married in the UK. Least I can work when I move on this one, originally applied for a K1 but for personal reasons got married in the UK instead and had to withdraw the application for the K1.

I know we have to get married in the U.S. within 90 days of arrival. We are getting married there because her parents wants to see her wedding as well. This is just a small wedding so their parents can attend since it would be hard for them to come to the US for  the wedding.

Wait until she gets her visa.

Good luck!

Hi,

My fiance had an interview yesterday in Tashkent, Uzbekistan and after the interview they didn't say if it was denied or approved. They just said it is in Administrative Process and that they will call her tomorrow with additional info. They never called her or emailed her anything. On the withe 221g there was nothing checked on the required additional documents checkboxes, which means she doesn't have to send any additional documents. What does this mean? I worry because we have already scheduled a date to get married back home and bought her plane tickets to bring her to the U.S. after the wedding. She said the interview went well and that the interviewing officer didn't say anything (congratulate or apologize) besides giving her her passport back telling her they will contact her soon. Does this mean they are sending our documents back to NVC or USCIS for further investigation? I wonder if they are undergoing additional background checks since Uzbekistan is a Muslim (not extremist) country? Any advise would help. Thank you all.

She might have said something confusing the interviewing officer just like you’re confusing us here... Those guys don’t like to come out as being confused they just put you in AP(Administrative Processing)

My friend just had her wedding reception including a church ceremony in Armenia with her fiance in July, he had his interview on 9/4 and got approved and just got notice his visa is ready and he can pick it up in a couple of days. As long as you don't get legally married under court of law then fiance visa can still be recognized. He brought pictures of their reception to his interview as proof that relationship is genuine, the officer did not have an issue with it.

So its not an automatic denial of  K1 visa if you have a reception or even get married in church, technically having a marriage ceremony is not recognized as real marriage unless a marriage license is signed by appropriate parties and filed, and you get a marriage certificate recognizing your marriage as legal and true. So don't worry too much, you might just need to wait out the AP time, many couples do reception abroad since family members from beneficiaries country might not be able to travel to US for the wedding. I actually know a few couples that did that and still got K1 visa approved.
