awaiting rejection notice; time is pressing

Good morning everyone.  First time poster here and I wanted your input to our situation.  Basically, I filed our I-751 with CSC on Aug. 27th.  My wife's GC expires on Sept 28, 2018.  However, I sent it the check for the incorrect amount.  It is now Sept. 11th, 2018 and we have not received the rejection notice and we live in San Diego, which is about an hour south of Laguna Niguel where CSC is located.   I called the USCIS phone number and I was told to give it 3 weeks for the rejection letter to be sent.  I'm not panicking just yet and I understand I would just have to re-send the application with the correct amount on the check.  Are there any other options other than waiting for the rejected application to be returned to me?  If let's say by the 24th of September I have not received anything back, could I just send a whole other I-751 with the correct amount on the check or would that just make things worse? Any input or past experiences would greatly be appreciated.  Thanks in advance.

I would wait for the rejection.  Late filing is accepted with an explanation.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Late is accepted but to get the 180 day extension you need to have filed on time.

 

Technically someone can file 751 as many times as they want so I dont see a problem sending a new packet with the correct check included. The first packet will definitely be rejected. Its just going to take time. I believe according to policy someone opens your packet and sees youre missing the check or its wrong or whatever. They have to log all kinds of things. Then either another person has to look at your packet and agree it is missing the check and then log a bunch of stuff before mailing it back- or the original worker sends it to the review dept who has to review everything and fill out more stuff- and then it gets mailed back. 

 

Currently USCIS is backlogged. Look at the wait for EADs and how long its taking people to get NOAs. You should prepare the packet and triple check it. Wait until 2-3 business days before the last day you can send it and have it get there on time. Dont wait until the absolute last minute. I did that today trying to go to the bank and it was closed indefinitely due to the hurricane. Use tracking number service. Then just wait. Eventually you will get your first packet back. There is no way it is making it out of the mail room, it just may take a while. Im thinking 45 days maybe?

I do not understand why they can not have you file online. It would be nice for us to be able to fill all the information online, pay the right amount online and send the relevant details in a package with barcode for your WAC number generated online. I guess i am daydreaming again. :)

Since September 10, you now have to send it to a lockbox: https://www.uscis.gov/unassigned/filing-location-change-form-i-751. When you resend the packet, payment with a credit card is now an option: https://www.uscis.gov/news/news-releases/uscis-expands-credit-card-payment-option-fees. Thus, a quick way to get credit card rewards, for applicable credit card programs.

Have you tracked when the application was received by USCIS? 

 

This happened to one of my friend and she did not know the amount was wrong until USCIS sent back all the package and notified for wrong amount. It took about 2 weeks if I'm not wrong. Her service center was VSC. Let wait for a little bit more if you are sure that USCIS received your package.

Thank you for the information. Great to know.  I sent it originally to CSC on Aug 24 and they received it on Aug 27th.

Yeah, I sent it with signature confirmation and someone at CSC signed for it on Aug 27th.  And when I called the customer service number they said to give it about 21 days which would be next week.  I'm hoping it will arrive this week so that I can send it back just in time before my wife's GC expires.  I read that I can file it late with an explanation.  If I go that route, I would provide the signature confirmation, the phone call to customer service and the stamped envelope by USPS that I filed on time just that I sent wrong filing fee and that it took forever to get it back.  Another route would be to just send a complete new application packet to the new lockbox address.  I'll wait until next Monday to decide what to do.

I think you have enough proof for late filing. I know it's hard to pick which option will be the best. Wish you luck and get the file back by Monday :)
