From your post, it seems doubtful that you came through the K1 process. Guessing it was some other visa, so guessing you did not send a ton of stuff beforehand like most of us then?

 

Remember to just speak the truth, tell your story and do not worry about any of that minor stuff if a question is asked about family etc...just say the truth. The joint account should be used for things like paying the lease/electrictiy/water/car-insurance. It does not need to have spending habits, but should sure have expenses you both share. People seem to keep making this mistake by not using the joint account to pay shared expenses, which then makes it much stronger evidence.

 

What about your taxes, did you file jointly for 2017? Is it at the same address that your lease is?

 

I would not scrap the text messages or receipts, recently those have been shown to be good evidence for lots of people trying to prove how their relationship started out. That said I would also take text messages that are everyday chat, you do not need everything lovey dovey always, just "i am at the mall, I am leaving work" kind of stuff. Just to show you communicate.

 

Could you add a mail at same address? Have examples of both of you getting mail at the leased address?

 

What about an advanced health directive? Since you have the family issues to overcome, an advanced health directive for sure will make your case stronger if you both do one.

>> Thanks for reminding me! I totally forgot about including this in the list. We did joint tax return for 2017 and we were already living together when we filed it (earlier this year). We will definitely be taking it with us.

You can do an advanced health directive easily online. For sure take the joint accont information and try in the future to make it a habit to use it more for shared expenses. 

Yah the mail should be fine, you basically just want to show you both get mail and have access to it at the same address. So yes again, take those.

 

Sorry meant do not scrap the text messages. Again just add some more casaul ones.

Most of your concerns don’t really matter. You don’t have to have a baby to prove your relationship is real. Babies, blegh!!! All the docs you suggested are more than fine. I wouldn’t worry about 8 and 9 on your original post. Not really relevant or required. Focus on the relationship now. Don’t bring gifts to interview. Bring receipts of gifts.

I think you should be fine. I was also F-1 and working on OPT when I met my husband. We got married 2 months after dating and didn't tell both our parents for the first 3 months (also did a private wedding with only us and a random guy as witness). We probably had same amount of proof as you (affidavit by landlord, joint tax return, phone bill, life insurance, car insurance, plane ticket, picture). 

 

For the interview, the officer asked how we met, basically observed our interaction together, went through all the documents that we submitted and approved us. I think as long as you are genuine and honest during the interview, you should be fine.

I'm in a hetero marriage and we've decided to not have children. It's not an issue for immigration at all, you don't have to explain the lack of them or anything like that.

 

My husband is an over-spender and I save every cent I can. What we did was create a joint account and pay all of our bills from it, or give each other money we owe to each other through it. It makes it look quite active and it's actually been very convenient for us. We have our wages paid into our own individual accounts and have separate credit cards and neither of those was an issue for ROC.

 

ROC was long, annoying and frustrating, especially with the technical issues USCIS keeps having. But in comparison to getting the visa to come here, it was a walk in the park. You send in one form with all of your evidence, go to a biometrics appointment and then wait for the outcome. Usually there is no interview for it and if you sent in a diverse package of joint thingies, you're not likely to get an RFE either :)

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Greetings, sorry for asking on this thread. Me and my wife got married June 2018 and were wondering what documents we should prepare for the AOS interview. A little summary about our situation- We are both young  22 and 23, and currently living under the same roof as my father who is helping me sponsor my wife with AOS. I am in nursing school and will graduate 2019, so until then i'll be working part time while in school not being able to be eligible for benefits, so i wont be able to include my wife in that. We have pictures of dates and with family members and a joint bank account under both our names. We will open a cell phone line for my wife as soon as her work permit arrives, so that plan will be other both of our names. 

 

Any advice on what documents or proof we can add while we wait for the aos interview is appreciated, thank you!

OP, my wife and I had a similar situation before AOS. We're a same-sex couple, no kids, some of my family members know about our relationship and marriage, others don't. Yet, at the interview we were not asked any questions besides what we had already submitted with our petition.

 

I think the amount of financial co-mingling and other proof of a genuine relationship that you have is good. We had about the same things, if not less. Pictures printed on regular paper, not photographs, are also very acceptable. 

 

Look into taxes submitted jointly - they like looking at that.

 

At the interview, be yourself and be honest. It's okay to not remember something. My advice would be to not go into detail about every little thing; just answer their questions short and simple. A lot of the things you are worried about might not even come up during your interview (but be prepared and tell the truth in case they do).

 

I would suggest refreshing the dates of when you entered the United States originally, how long you stayed for, and all the details of how you changed your visa from F1 to OPT. From what I've seen, officers do like to ask questions about previous visas and how one got to be in the U.S. (if visas are different from K1 and spousal visa).

8/30/2022 - case status updated to "Ready to be scheduled for an interview".
12/07/2021 - divorce granted (we had been having issues and the marriage didn't survive). I asked to switch my petition to Divorce Waiver and sent the request off along with my reply to the RFE.
05/31/2023 - case was updated at some point to show that my biometrics were taken (they re-used the ones I provided at AOS) and on this date, status update to "Ready to be scheduled for an interview" again.
No more updates were made; I assume this case was approved as I received my citizenship.

2/5/2024 - filed N400 online under the 5-year rule (with pending I-751).
2/9/2024 - Interview scheduled for the end of March! The fastest I ever got anything updated! Not sure if it's a combo interview or not. Following advice here, I uploaded a simple Word doc asking to waive the ROC interview or do a combo.
3/27/2024 - Interview. It was a combo interview of both ROC and 400-N. I passed the test, but a decision could not be made as the officer had to review my 2-inch-thick ROC case file.
4/8/2024 - online status got updated that an Oath Ceremony was scheduled and that they mailed me the notice! I got it in the mail 8 days later.
5/9/2024 - Oath Ceremony. I am a U.S. citizen!!!

As for your list above, lease agreements with both names good. Joint bills with both names, good. Joint car insurance good. Health insurance and all good. Those are main things that show mingling.

 

The receipts from dinners and such, not so much just means you two went to eat somewhere.... but you can use them if you want to. Gifts, not sure that holds much weight either.

 

The joint bank account is good though. We have only a joint savings, but kept separate checking accounts.

 

Court house wedding is fine, it's legal so... we did the same. 

 

Literally for us, as we didn't have to do the AOS interview or anything, we only sent with out original I-485 packet, copy of joint lease with both names and the joint savings account. That was it. We didn't have time to get everything else in order to go with it; but we had no issues. 

 

So again for you, joint lease, joint bills, the joint account, car insurance and medicals all are good things. 

 

Perhaps you have a life insurance policy where your spouse would be main beneficiary of the money? That is also good evidence.

For immigration purposes, ' just' having a baby is not considered proof of relationship. If it made immigration easier there would be many people  who happened to get pregnant right before filing. Just like having met once does not mean you are in a relationship (a hard requirement for the K1). But it is or can be part of the evidence. If you add having a baby to the other evidence you have, then it probably will be considered in with the rest of the proof. 

' Just'  having a baby does not prove a relationship, it only proves you had sex. And tbh, with todays technology it don't even prove that.

Exactly as others have said, using a pregnancy or child as "evidence" would be merely a tool for immigration purposes and everyone would just be getting pregnant to have this "proof".  People will do ridiculous things to get what they want including to get to the US. Think it hasn't been tried before? I'm sure it has been done. Why do you think pregnancy isn't "expedite" criteria? (except for in some specific/dire situations) Cause a lot of people would abuse it.
