Hi,

Yes, I think we need to give CSC time, I think it is 6 months from Receipt date (RD) or NOA1 I do not know. My NOA1 is 1 month after RD

Well CSC processing times in the website says 6-months which is October depending on RD or NOA1.

So technically end of this month April filers should be getting approvals but if not and if CSC website says processing time is now 7-months in November what we do?

Thats when we need to step up and petition. For April filers I think it is little too early to react with a petition but this option should be on the table and we need to find more people ready to sign the petition so that when November come and no approvls we are ready to contact Senators.

Any comments?

Hi All,

I share the same frustation, pain, heartbreak like you all. Infact, being a first week of June K3 filer, my wait is probably going to be even worse than April filers..

Anyhow, going back to writing letters letters to USCIS, Senators, media.. et al, for anyone interested in doing so, I would highly encourage them to read thru the K1 VSC filers thread in the K1 progress and reports forum. Apparently, VSC has hardly given out any K1 NOA2 in past few months and hence their waiting time has grown from 30/45 days to more than 120 days recently. VJ members in that forum has already drafted letters/docs etc that anyone could use as is or with some very minor edition. They have addresses and everything listed in that VSC K1 forum. Theie letters have also included "K" visas in general and also has a mention of prolong delays, esp at CSC. They are trying to highlight USCIS problems and long delays in general(mostly for fiancee and spousal visa), irrespective of one'e service centers. They are encouragaing all of the K1/K3 filers of both the service centers who have already waited for a long time to join in their movement but in reality ANY K1/K3 filer (recent or veteran) can use/print those letters to send them to CIS Ombudsman, Congressional representatives, media and other appropriate authorities to highlight the long recent delays of USCIS', esp in fiancee and spousal based visas. From my readings so far, what I can infer is that they are NOT just trying to highlight problems at VSC vs. CSC or preference of one family-based visas with another. They want to bring attention to general recent USCIS's delays and how we hardly have any communication from USCIS. For ex, them abruptly dropping of K3 tracking and reporting from their monthly tracking on USCIS website or how some of the dates are just plain "6 months" and how their no accountability. Anyhow, if anyone needs more info on this then please read the K1 at VSC filers thread and you will see/understand wha exactly are they trying to accomplish.

hello everyone

i take it that it hasn't been a good week for most of us

well, i have an update

yesterday a USCIS packet arrived at feelicks' place, our K3 packet was mailed back to my husband

they removed our pictures and restapled them in another jacket thing and on top is a form with 10 choices

the one with an X is choice #3 and it says, "our records indicate that your I-130 is no longer pending. the I-129F (K3) petition for your spouse can only be accepted by the service center if the underlying I-130 petition is currently pending."

great. thanks a lot, USCIS. in the first place it was your fault we weren't able to submit our K3 immediately like everyone did

ok so feelicks called USCIS numerous times and finally got to talk to someone

they told him what we can do now is mail in my son's I-130, with the new fees (370USD according to the USCIS CR) and attach a note to expedite it since mine is already approved

expedite and USCIS is like an oxymoron to me

and why it's 370 and not 355, i don't know - maybe it's the expediting fee?

together with this unfortunate developments arise a couple of new "issues" for me and feelicks

first, how the hell do we go through IR-1?

second, how much time do i have before my visa is "forfeited"? obviously my son's visa will arrive way after i get mine, and i will NOT leave the country without my son

third, silly as it may sound, do you think the people in the IR-1/CR-1 section are just as nice and accommodating as you all have been here? :wacko:

everyone seems to think that IR-1 is actually better than K3

at the moment, it doesn't matter to me

i see only two things right now: longer separation and more waiting

it feels like feelicks and i just lost all hope

i am so frustrated and i really really REALLY hate all of this

please excuse my hormonal and emo self, thank you very much

i got this from the IR-1 step-by-step guide page here in VJ

"Your relative will become a U.S permanent resident only when he/she enters the U.S at a port of entry, until this time, he/she only has an immigrant visa that is valid up to 6 months from the interview date. If your relative cannot immigrate to the U.S within the 6 month allotted time, then his/her immigrant visa will expire, and the I-130 process must start all over again."

so that deals with one of the issues...

feelicks and i are thinking of delaying our NVC fees and other requirements a bit so that we can buy time for my son's I-130 and let it can catch up with mine in NVC

as for a separate thread, well i guess it's goodbye to "april K3 filers"

i will drop in from time to time to see how everyone's doing

Neenuh,

I130 processing takes about 4-6 months at NVC. You can speed that up to about 3 months using James' shortcuts. You can also slow it down by dragging your feet with the fees.

What you can do is submit your sons I130 with the expedite note. Pray that someone at CSC can read and does read it. Drag your feet a bit with paying your fees. If your son gets that expedited I130 approval, you can start both processes up again, using the shortcuts if needed for your sons petition at NVC if you have advanced yours prior to his approval. If it gets approved really fast, then you can pay the fees for both at the same time and hope they go through to the embassy together.

You should read over James' shortcuts, and nose throught the CR1 guides. And yes, the people in the CR1 forums are just as helpful. Best of luck!

Good luck Neenuh. I still suggest calling NVC and asking in the AR1/CR1 forum to see how long you can delay your I-130. I think knowing how long the NVC will hold your I-130 petition is a crucial piece of information for you and Feelucks.

Sorry to hear about your situation but dont loose hope. Do keep fighting and things will fall into its place. I wish you ALL THE VERY BEST and please do drop in once in a while in this April K3 filers thread... coz as of lately the way USCIS/CSC has been working on K3 visas, which is to say hardly, I dont have any idea how long we all will be stuck here...I feel extremely sorry to say what I just said but sadly there is some truth in it. To make things even worse of me, I am a June K3 filer so I am lookin at even longer wait. :(

Anyways, thanks a lot for your wishes and good luck. :thumbs:

Neenuh, the 4-6 months is if you pay the fees and return the forms as you receive them. You can drag it out for quite a bit longer. Based on responses that others have received when calling NVC to see how long they could hold off the I130, NVC will not consider your petition abandoned without contacting you, and you should be able to stretch it out without problems. But, yes I agree, you should call NVC to see what they say.

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.
