our I-130 got approved, yay!

the hard copy arrived today

unfortunately, we never filed an I-130 for my son - thinking K3 was going to be faster

but we are pursuing the K3 just the same

this is good news, nonetheless :)

as for our K3, i worry that we sent it a little too late

Yes, that is the NOA2. They will process your I129F (especially if you delay the I130 by not paying the fees when the bills arrive), but no telling how long you might have to wait. I have followed your and feelicks' USCIS saga. If the interview wait isn't much different at your embassy, maybe its worth pursuing the CR1? and avoid having to deal with USCIS for AOS later.

One of my greatest fears is that they won't send me an email approval. I am afraid the mail will get lost....

Urge, do you have any thoughts on how Neenuh and Feelicks could quickly get a visa for Neenuh's son through the !-130 process? I felt the K3-K4 route would be the fastest way considering their situation.

edp, I forgot about their not filing the I130 for her son. That throws out what I said above. Neenuh, you definitely want to avoid paying the CR1 fees when they arrive from NVC, as you will need the K3 to get through.

Timeline

I spoke with USCIS CSC just a minute ago. Like others I'm very disappointed at yet ANOTHER significant delay in my paperwork. I wanted to understand why it is taking so long to ship the I-129F to the NVC. This is what the kind Chinese lady told me.

For an I-130 application, they can simply send the application "as is" to the NVC. Therefore, shipping the I-130 is pretty quick.

For an I-129F, K-3, application, the paperwork has to be physically manipulated by hand by pulling certain documents and putting them into new file pouches. Then the I-130 application has to be filed and stored to be held for the AOS. This is what they are referring as the staging area.

I asked how long this should take. She replied saying they don't have a good estimate, since they are new to this process. (As we all know by now.)

So it looks like we are being held up by the huge backlog or surge in applications. We just jumped in at the wrong time for "quick" processing. She said it's been taking about a month.

It now doesn't seem to me that we are just sitting around waiting to be shipped. Instead we are again finding ourselves waiting on low resources to deal with the surge they have experienced. Funny, you would think they could keep up with the pace of adjudication. But that would be too logical of an assumption.

Hope this helps. For me, IF THEY WOULD SIMPLY EXPLAIN THE SITUATION AND TRUTH OF THE MATTER, I wouldn't have been as frustrated. Although, I have thankfully handled this much better than I anticipated.

As my mom says, "Don't pray for patience. The way you learn patience is by waiting." I have not been praying for patience, but I still received a nice, long wait. :clock:

Going back to your disappointed comment, I totally agree with u... As a matter of fact, as many VJers already know (gogo, urge, My honey etc..), I have already expressed my disappointed in USCIS/CSC over the whole CSC to NVC growing wait times... Apart from getting a RFE or stuck in AP/AR.. the CSC to NVC wait time is actually one of the worst things to deal with... not only becasue its the "new" added wait to our already dealyed NOA2 but because its seems rather stupid.. Even if we consider the CSC customer rep's comment, its not like they are approving tens of K3 PER day so that they need about a MONTH or so to pair of the I-130, filing, shelfing and what have you... I do very well understand that CSC employees are working in other areas but to have the transfer to NVC time go from about a week or so to more than a month is just unacceptable, disgusting and heart-breaking... Oh wow... it does sound like we are dealing with USCIS...

Aight I m done whining for the day :)

Anyhow, good luck to all and a day will surely come when we all will be out of CSC's grip :thumbs:

Hey guys....

I got touched today for the first time for my 129f.... they said they need more evidence and that they will not process my paperwork until i provide them with the required evidence... did this happen to anyone.. i think i am going to die until i recieve this letter in the mail!!!!!

Thanks for sharing this with us. Now we have a glimpse of what is waiting for us on the other side of the NOA2. I agree with pkwel that the people at CSC are just plain ridiculous. VJer Baaj just got his NOA2 on Sept. 10, and he is already through to NVC from VSC. By most accounts, it still seems that VSC can still send things in a week. They should similarly be as new to the pairing petition process as CSC, but they know how to handle it. CSC just sits and stares. If adjudication is the bottleneck, then this staging should be quick... you should not have 2 bottle necks back to back. Only at CSC would this be possible and acceptable. Ok, I'm done with my urge to rant.

exact reason we never sent the son's I-130 - feelicks and i were after being together the soonest possible time and we thought the K3/K4 petition was going to be a faster route (we based this from the timeline in the manila embassy website)

sadly, we do regret not sending an I-130 for the son

oh, if we only knew :sigh:

you know, with all variables to consider (i can't just leave work in the middle of the school year and the son is finishing elementary in march), we have no other choice but to wait for the K3/K4 visa

i just really hate being apart... we all know how that one goes, right?

so, do we inform NVC regarding our K3 route? (i read about Divine Mercy's post, btw) or do we just delay payment for fees, as suggested by Urge?

i thought i'd lift everyone's spirits here... it's been rough and i feel for everyone

i know we all want to be together with our SOs asap, but keep the faith and focus on strengthening your relationship with your SO as much as circumstances would allow you - make the most out of this experience - remember, a year or two apart is minimal compared to a lifetime together :)

neenuh, I suggested to Divine Mercy to contact NVC, and you saw the response she got, so it might not be needed, just don't pay the bills. If it were me, I would call NVC myself anyways. USCIS gives different answers everytime someone calls with the same questions, so I would want to make sure that I get the same answer from NVC (just to be sure because you might get a different answer).

so, do we inform NVC regarding our K3 route? (i read about Divine Mercy's post, btw) or do we just delay payment for fees, as suggested by Urge?

03/12/2007 - Married to my beautiful wife

04/16/2007 - Sent I-130 to VSC via USPS Express Mail

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.
