It would be great if we had an approval by then :yes: (even better if the case went through NVC by then :yes: :yes: , but let's not put the cart before the horse, although its hard to figure out since I can't seem to find the horse :wacko: ).

Thanks for bumpin this... btw, you know things are going REALLY REALLY bad @ USCIS when someone has to bump an April K3 filers thread in the month of September... This is like an epitome of wait times.. but since we cant do much about it..thy shall wait for their NOA2... This is getting, if not have already gotten, ridiculous IMHO...

Anyways, dint meant to vent in the morning.. well for me in the PST zone... e'one have a great day and lets hope for many many NOA2 in next few days... Good Luck :thumbs:

Thanks pkewl. Yes, it is well beyond ridiculous. Of course, CSC is approving May K1 filers. They just don't like us K3s. VJer One heart got approved from later April, but they were processing that as a CR-1 until the I129F showed up at the last minute. Don't let it get to you. We'll get there in time.

I have a quick question for someone who can shed some light on this..

But first some brief backgroud info. Since we filed I130 first, I also have my name in the I-130 filers list in the IR/CR1 forum. Take a look at VJer djturbo's case dates and his NOA2.

His/her Timeline:

05-11-07 Mailed I-130 to TSC

05-12-07 USPS confirm delivery in TSC

06-05-07 CSC receives I-130 from TSC

06-08-07 Check is Cashed

06-11-07 NOA1 Received from CSC

09-14-07 TOUCH...after 100 days! I-130 APPOVED

Djturbo and I have a pretty similar timeline in that we both mailed our I130 to our respective service centers around the same dates(him on 5/11 to TSC, mine on 5/15 to CSC). He received his NOA1 from CSC on 06/11 whereas mine was received on 06/07. But as far as both of our I130 NOA2s are concerned I m NOWHERE near to getting my I130 approved anytime soon. I have had no touch since 06/05 on it.

So the question is did he get approved already because he doesn't have K3 going on with his I-130 or is it becase he is a TSC --> CSC filer or is it due to a combination of both the factors. Regardless, I am not too bothered by it. Its just that a few days ago someone (outside VJ) told me that for petitioners with ONLY I-130, it tends to get approved little faster (vs. say I130 with K3) but the next big wait for them is at NVC. Is that true or u guys seem to get that impression??? If and again IF true then doesn't it kinda defies the whole purpose of filing K3. I do understand that as a K3 filer, I 'll have some leverage at NVC level but if someone who only filed I130 with me and if he gets approved say about two months before my K3 NOA2 then doesn't that make a moot point for people to file K3. I know I thought I 'd ask this question to satisfy my own curiousity.

Pkewl, nobody on VJ seems to know for sure why some petitions are adjudicated faster than others. The ex-adjudicator on the K1 thread said they use to approve a petition that was prepared well early every once in a while. Here is a link, but the thread is long:

There has been a few AR1/CR1 petitions approved early this summer, but as pushbrk says, there has not been emough AR1/CR1 petitions approved early to make a trend. You are correct in stating the biggest time differences are at the NVC and Embassies. It normally takes a K3 5 to 10 days to pass through NVC, but like everything else recently, even that has been delayed. An AR1/CR1 petition normally takes 3 to 6 months at the NVC because of more processing. Then there is normally more processing to be completed at the Embassy, but the different Embassies seem to vary greatly in the time it takes to grant an AR1/CR1 interview.

my husband's flying early december for a visit too

perhaps even extend til interview schedule, so we can fly back to california together

this is all, of course, in the hopes that we get an approval around january

my concern with this is the I-134 packet - with my husband flying here before an approval, the CO might not like to see an "outdated" I-134 during our interview... any thoughts on this?

Yes, having hung around VJ long enough, you will see that IR1/CR1 I130s seem to get approved faster than K3s. The reason is quite logical. Ignore our severe delays in getting our I130 NOA1, and assume that like in months/years past the NOA1 came in 10 days. A plain CR1 filer sends the I130 petition on April 15, gets NOA1 on April 25, with a receipt date of April 21. The "priority date" for that petition is April 21. Now, say you petition for a K3, sending the I130 on April 15, get your NOA1 on April 25, with receipt date of April 21. Then send your I129F on April 27, get NOA1 on May 4, with receipt date April 30. Now, when they pair your petitions (as they really try hard to do these days), April 21 means nothing to you and your petitions. Your priority date is April 30 (later than CR1 guy). Furthermore, your April 30 priority date cannot be related to the CR1 filers April 21 since they are different petitions for different visas. There is also little relation to a I129F for K1 with same receipt dates, different visas right.

Now, you add our delayed I129F petitions because of the check cashing and receipting delays, and we get pushed a little further back. In the past sending an I129F very late got the I130 processed like it was a CR1, but for us that doesn't apply since CSC was at a total standstill at that point. It seems like a really sever delay now, but when we are all pending AOS, it will not seem so big anyway.

Also, yes as edp pointed out, NVC takes so much more time with the CR1/IR1 than with the K3s (4-6 months vs 5-10days), if reuniting with your SO is of primary importance, then K3 is worth while. On the other hand, in the big picture, if you can wait to be with your SO and getting permanent residency status is of primary importance, then CR1/IR1 is worth considering, because for K3s you have to factor in AOS time to get LPR status which can be quite long while CR1/IR1 get LPR status immediately.

I do understand that as a K3 filer, I 'll have some leverage at NVC level but if someone who only filed I130 with me and if he gets approved say about two months before my K3 NOA2 then doesn't that make a moot point for people to file K3. I know I thought I 'd ask this question to satisfy my own curiousity.

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

my husband's flying early december for a visit too

perhaps even extend til interview schedule, so we can fly back to california together

this is all, of course, in the hopes that we get an approval around january

my concern with this is the I-134 packet - with my husband flying here before an approval, the CO might not like to see an "outdated" I-134 during our interview... any thoughts on this?

The fresher the I-134 / I-864 information is the better. I cannot say for sure, but if the information was acquired in November and you explained to the interviewer at the US Embassy that your husband has been living with you in the Phils while waiting for the visa, he/she should understand. As I suggested earlier, your husband can file his 2007 tax return online from Parañaque and print a copy for you to present to the US Embassy.

I would like to add a little more information to what Urge and I have already posted. djturbo's petition was approved in 100 days and that is 50 days quicker than the current VJ average for I-130s. If you look at the processing times for September an I-130 averages 150 days from NOA1 to NOA2 at CSC. The September average for K3 petitons is 140 days at CSC.

The first NOA1s are now averaging 40 days. So if you add the 140 day average between NOA1 and NOA2 to the 40 day day average of getting an NOA1, the K3 approvals are averaging 180 days from the NOA1 I-130 receipt date. So if we follow USCIS directions and send in the I-129f petition with a copy of the I-130 NOA1 our approvals are currently averaging a month longer.

Just spoke with USCIS. They said they're processing applications for around March 15th. So very soon they'll get to April! Btw, this was for California center.

jenya, do u know if it was the date the applications were recieved by USCIS or the notice date when they issued the NOA1..thanks
