Disclosing out of status in interview

Timeline

Hi everyone,

 

quick question. What has been everyone’s experience during their AOS interview about disclosing that they are out of status (if you are). My husband is a citizen and as our lawyer explained it, once approved for a GC my time being out of status won’t matter. However, I’m worried about them asking my husband what i do for a living and us having to disclose that I am not doing anything because I am out of status as of August 4th from f-1. 

 

Any tips or anecdotes about how you guys handled it would be awesome. Interview is a month away and I’m getting nervous!

Non issue... once you had the NOA1 for the I-485 you became in a legal status and any ":out of status" time is ignored/forgiven. You're stressing over something that won't even be brought up.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Not a lawful status, but "authorized stay" allowed by the US Attorney General.

you should be fine buddy. Just enjoy the break from school! Easier said than done, right?! Btw, are you able to get driver license by just using your i-797 receipt in cincinnati?

Timeline

You are perfectly fine. Btw, they know all that do not need to disclose it. They can figure it out from your paperwork, or a simple question "are you still in school?". Again nothing to worry about, just always tell the truth.

I’ve had my license in Cincy since 2014 so I’m not sure. I always had to show my visa and I-20 though. And yes it is nice to not be in school!

Very true. Thank you. We managed to do everything without a lawyer so I had a momentary freak out where I felt like I might need a lawyer because I’m no longer in status. I’m glad I have you guys to calm me down! :)
