Hi. Iam wondering what is faster; try to get a k1 visa or marry in spain and then apply for a k3 visa, does anyone knows what process is faster? also I would like to know if the Affidavit of Support on the visa k3 works like the same than in the k1 visa, I mean, I know that for the k1, someone can support you, does this work for the k3 too? thank you!

K-1 is slightly faster due to not having to first file I-130 and wait for NOA1 of that petition to then file for K-3 using I-129F. K-3 has a few advantages over K-1, you can set a wedding date, marry, and then file for the visa, this allows setting a wedding date. K-1 is quicker if you don't have a set wedding date in mind.

Yes the same standards of Affidavit of Support used for K-1 apply to K-3. I-134 used at visa interview, and I-864 used for AOS.

The affidavit of support works the same for both K visas.

One more speed advantage of the K1 is that if you've already met in person in the last two years, you can file now instead of waiting until you marry.

That said, I generally recommend people decide what course of action is best for them, marriage in the US or marriage abroad and then simply file for the appropriate. If speed of reuniting in the US is the overwhelming concern, K1 is the best bet.

If marriage and minimal time off work for the foreigner are key, then CR1 is the ticket.

If marriage first or abroad are top priorities followed by speed, then K3.
