Hello everyone,

 

I'm trying to figure out why I have gotten a rfe I know that I will be getting a letter in the mail soon but trying to figure out why. I have a immigration lawyer that has done my application so don't see where the issue can be from the application it self. One thing that i have done is add her to my credit card as an authorized user for emergency situations. Can this cause a RFE? Also, the only reason why I know I have a rfe is because the old site altered me via text and email and the app. The new site still says that my application has been received.

Having immigration lawyer doesnt guarantee 100% non issue process or even approval. As shown on this website, lawyers actually mess up a lot. 

 

All you can do now is wait for RFE letter. No one can say why you recieved one.

I highly doubt it has anything to do with credit card and the like. From what I've observed so far, they are pretty strict to sticking to basics:

  • Making sure ALL the questions are checked and answered at 129F. Forgot a checkbox? RFE.
  • Required documentation, letters of intent, divorce certificates if needed, etc, nothing extraneous.
  • Additional proof of meeting in person in last 2 years.

From what I observed, lawyers don't seem to do any better than self filed ones. In some cases worse, as due to their busy schedules they sometimes tend to "forget" things. 

 

Good luck, and remember to update us once you actually have your RFE in hand!

Don't think it is the credit card issue at all. My fiancee has been an authorized user on my one credit card for over 1 year now, about 6 months before filing the K1 I had her added to my Credit card. It was an easy way to avoid having to send her money and pay fees. The card has no foreign transaction fees, and you get a pretty good exchange rate with a credit card. If you do need to send money I recommend Transferwise.. They have low fees, and they work great transferring the money right into her bank account.

Agreed....not a credit card issue at all. They wouldn't even have a way of knowing this.

Nobody knows what the actual cause it. Usually it's something fairly simple (missed box/field on the I-129F, missing letter of intent, lack of evidence of meeting within 2 years, lack of divorce or criminal court papers, etc.).

It’s probably more mundane.  Missed signature, wrong format of something.  Sometimes they just overlook a document that’s included and request it again.  Usually it’s just about there being a complete package to check off on their checklists.

Sometimes this is frowned upon as it may indicate that the person is 'buying' their spouse, or that the couple is 'too married'. It's often recommended to be done AFTER the K1 when you file for AOS that way your spouse can show that you have joint accounts as proof during your interview.

Too many people. :P The main issue is that an authorized user on a credit card doesn't really show financial commingling...just that one buys stuff. Financial commingling consists of a shared responsibility.

Generally there's no harm in including it (although it can - along with other evidence - paint a picture of being used for money, a common scam in certain countries), but not really a benefit either.

This may be viewed differently for a married couple since (usually) debts incurred after marriage are legally shared, so even an authorized user shares the responsabilities.

Hey guys so I finally found out why I have gotten. A RFE it's because there were 3 questions that my lawyer did not answer which is a stupid mistake if you ask me. Now that I have fixed it I am wanting to send it in. Do I need to attach the page that asks for the passport pictures or no? Also can I send it back expressed so that I can have a tracking number so that I will be able to know when they receive it.

Without seeing what RFE explicitly asks for, we can't really help you? Send everything that they sent you back. Follow instructions explicitly. Do remember to sign your corrections. Sorry about your lawyer, unfortunately that just confirms my belief in their lack of usefulness (and possibly harmfulness) when dealing with routine 129Fs.

Was I supposed to sign the spots that were circled and highlighted? I didn't bother signing because the original form this and two other questions were not answered and see no space for me to sign. So I did not sign. Should I sign right next to them?
