F2A Visa process

Timeline

Hi all,

 

I am petitioning my youngest brother who is 20 year old now, my Mom who is a permanent resident is the petitioner.  I send  the I130 package last August 27th, and was received 8/31/18. We received the notice of receipt letter. Last activity on file 8/31/18. Question: What should be the next step? Thanks in advance.

 

Timeline for my 20 year old brother/

8/24/2018  Mail I130 via Fedex

8/27/2018  Received by NVC

08/31/2018 Touched

Wait. So are you the petitioner or your mother ? Please specify since that's important.

I believe you meant that you are filling out the form, that isn't petitioning, your mom is the petitioner

 

you are just completed the form for her,

 

The next thing is the receipt, she will receive the receipt, from there many years of waiting, because your brother will turn 21 and approved after he turns 21,

so even if he is a minor child of a resident, he will turn 21 in the process and the wait for an unmarried child of a LPR is over 7 years, so he will be approved as an F2B and must be unmarried at all time until he enters the US

 

now, how did she become a resident?

Sorry for the confusion.

Mom is the petitioner. She's Green Card Holder, a permanent resident.

I am a naturalized US citizen. Mom came to US through me. Process was fast, less than a year.

Wow, I didn't realized that a Mother petitioning her unmarried, minor child will take 7 years.

By the way, my brother's PRIORITY DATE based on the NOA 1 is August 27, 2018. What does it mean?

 

Too many questions, it's been a while since I process mine and my mom's immigration papers.

09/03/2018 NOA1

I didn't check the country and your family is from the Philippines, right?

 

It will take way longer than 7 years for your country, for F2B, immigration is working on the year 2007

 

so more likely over 11 years, maybe 12 or 13 years, who really knows what will happen in such a long time

Yes, home country is Philippines.

 

Since my Mom is the petitioner, and my brother is unmarried under 21 years old, I believe he is F2A.

 

Do you know how long is the process for F2A's?

 

Wow, such a looooong time for F2B's.

He’s a minor now but he will age out during the process so that fact becomes irrelevant.

See table A, F2B for Phillipines has a current priority date of April 2007, so it’s an 11.5 year wait at the moment and will almost certainly get longer.

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

to clarify

 

You aren't filing for your brother, your mom is, you have nothing to do in an F2A petition

 

your mom waited too long, she should have filed for your brother as soon as she got here
