hello everyone,

A friend of my husband who lives in the philippines wants to work here in the united states as a caregiver. Hes application in israel is currently pending. So, He is hoping to work here instead. I don't know what to tell him because my knowledge regarding work visa is limited. I know that a employer needs to file a petition for him. What are the steps? What are the chances that he can work here?

Thank you.

First step, as noted, is finding a US employer to petition for her. The company's lawyer handles that part of the process...communicating when them would be the best course to take.

Working as a "caregiver" may be very difficult, depending on what exactly she does for a living. For instance, a Registered Nurse (RN) can usually qualify to apply for an EB class visa. A nursing aid or similar likely would not meet the labor certification requirements for many work visas (to ensure that there is not a qualified US-authorized worker already).

Filed: K-1 Visa Country:
Timeline

She needs to have a job lined up before as applying for the visa will be dependent upon the company who hires to support her for a work visa. Those are hard to get as they have to prove that a person already here and legally authorized to work here is not capable of doing the job she would be doing. Those visas also usually require at least a bachelor’s degree. She needs to find a company who would be willing to sponsor her for a work visa first. Then apply.

In most cases people who have a dream to work in the US, but don't have a degree or a good occupation , will never move to the US.

I doubt anyone will go through the trouble of sponsoring a caregiver when there is thousands of thousands of USC caregivers already in the country.

Also usually people who have a shot at work visa do the research themselves. They are not lazy enough to ask friends to do it for them.

Harsh but true.
