What visa do I need? K-1 or I-130

Hi guys, some update.
 

After asking my partner.

We are bit confused what we should do.

 

My partner will lodge for naturalization in November.

And it seems the process will be faster if he got the citizenship first.

So, it seems there is 3 options right now.

 

1. Waiting for him get citizenship first. then apply I-130
He will lodge N-400 this November.


2. lodge both of the form regardless of time.

So, he lodge N-400 and I-130 in the same time. regardless the situation.

 

what is your advice in here?

Does your partner realize that it could take a year or even longer to get his citizenship after applying? He should file i130 for you now, lodge n400 at the appropriate time, and when he becomes a citizen he can then upgrade the petition if it hasn’t reached the visa stage yet.

He will talk to lawyer next week, so I guess he will get idea of the time frame and how long it takes to get citizenship or F2A visa.
 

You were just given one.  Its faster to start the I-130 for the F2A and then upgrade it to the CR1/IR1 afterwards.  Dont wait.
