Good attorney for ROC?

We have decided to use a lawyer for this step, given the political climate.  Can anyone recommend a good attorney with experience in ROC?  We have been fooled in the past because our lawyer had experience in asylum cases but not what we were doing.   It made everything worse....So it would be best if the lawyer has lots of experience with ROC.

I fully realize this is pretty straightforward, and we don't have to have a lawyer, and can do this ourselves.  We are choosing not to do that.

12/11/2018 - I-751 mailed (requested a fee waiver) to Lewisville, TX via FedEx

12/13/2018 - package delivered 

01/02/2019 - received text message from USCIS with case number starting with EAC

01/12/2019 - submitted online e-Request for non-delivery of NOA (the extension letter)

01/24/2019 - received the response to e-Request via e-mail, which says: "Please allow 30 days from the date of this correspondence for the notice to be sent".

01/28/2019 - received NOA (the extension letter), which extends GC for 18 months

01/29/2019 - received biometrics appointment letter

02/08/2019 - biometrics completed

Agree. lawyers hope you in trouble when you are in pursuit of  sth then they can get more money from you.

If you have no trouble, they will make some trouble to you.

No straight forward ROC case should need an attorney....even in this "current political climate"...it looks to me to be a thousand times easier than a spousal visa.......but good luck in your search.....I hope you find success in your journey.

I would consult one of the immigration specialists listed under "Professional Help" here on VisaJourney before I hired an attorney....just my opinion.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

We used a lawyer to file the I-130 before we found this site, and on top of being expensive ($1000 for only the I-130 portion of the case), all it did was delay our case.

 

They ask you to fill in their form with all of your information so that they can transpose it to the actual government forms.  This cost us about 4 weeks' of a delay to get our case submitted, when we could have filled in the info one time on the actual form and sent it in right away.

 

If you're thinking it will save you the time to fill in the forms, you still have to spend just as much time providing them the details, along with all of your evidence anyway, so might as well do it on your own for free.

Mar 2014 - Married

5/7/14?? - Attorney mailed paperwork

5/15/14 DHS cashed check

5/19/14 - NOA1 received with PD 5/12/14

10/17/14 - NOA2 received

10/28/14 - Email received that file has been sent to NVC

11/13/14 - NVC received file

12/10/14 - NVC Assigned case number

12/12/14 - AOS Fee Invoiced

12/13/14 - Submit email to NVC to remove attorney as DS-261 Agent

12/16/14 - AOS Fee showing as Paid

12/17/14 - IV Fee invoiced

12/20/14 - IV fee available and paid

12/27/14 - DS-260 submitted

1/2/15 - AOS and IV packages sent to NVC

1/5/15 - USPS delivered packages to NVC

1/7/15 - NVC scanned in packages. Let the countdown begin...

1/30/15 - FINALLY got a reply to my email to remove the attorney from the DS-261

3/9/15 - Called NVC and they have checklisted us for an "incorrect" decree absolute from the UK, even though it is the legal official document. Have requested a supervisor review.

4/28/15 - Called and NVC said supervisor had reviewed and now claimed that the decree absolute was not included. After disagreeing with the less than helpful lady on the phone, and her not being able to get the review time right. (She kept changing her story between 42 days and 30 days).

4/30/15 - Sent the same copy of the decree absolute to the NVC from the UK, highlighting the "decree absolute" wording with a letter stating that this is the only document provided by the UK government.

5/6/15 - Scan date for checklist received.

6/5/15 - Case complete!!!

6/12/15 - Called and interview is scheduled for July 1!

6/14/15 - Received email with interview date and instructions.

6/19/15 - Case showing as ready on CEAC.

7/1/15 - Approved at interview!!!

7/6/15 - CEAC changed to Administrative Processing

7/7/15 - CEAC changed to Issued!!!!!

7/10/15 - Passport and packet delivered!

7/29/15 - Husband entered with visa at Dallas/Fort Worth airport

9/29/15 - GC delivered!!!

5/4/17 - ROC packet sent via USPS

5/9/17 - Tracking shows delivered

5/17/17 - Check cashed

5/19/17 - NOA1 received with date of 5/8/17

5/27/17 - Biometrics appt received 6/8/17

I agree. We’ve tried to use a lawyer too during my previous K1 process and it turned out that he put the incorrect info on my form ( the amount to put on the check) which led to return the packet I have. When I  found this site I did everything since then - from AOS, ROC and N400. 

Pros of not having a lawyer is it will save you tons of money and time believe me especially if your case is pretty straightforward. All your resources can be found on this site. Best of luck!

We used a lawyer in our first application and let me tell you it was the WORST decision ever. That lawyer was so stupid it was unreal, even though he had a lot of good reviews, but we think they were fake. He made a lot of mistakes, and also ignored us completely every time we had questions. Complete waste of money. 

Do not use a lawyer. Filing an I751 is very easy. It will save you a lot of money.

Google "immigration lawyer + zip code" if you must, and interview 2-3 before retaining.  But i751 is easy and straightforward to do on your own. 

 

We had a lawyer for CR1 (but not for ROC). And it turns out, we knew more than the lawyer.

There is nothing about the political climate you need to be concerned about (unless you want to start an anti-President Trump post?). IF you are legally entitled to the 10 year I-551, then you will get it. Nothing more, nothing less. I would not get an attorney....our guides on here are fantastic. I used it for ours as well as referred others to it

Honestly I wouldn't worry about the current climate in regards to your status, and I say this as someone who would not have voted for Trump. They're going after illegal immigrants, not legal. Until that changes, I really would recommend that you file this yourself. The amount of immigration lawyers who don't seem to be able to tie their own shoe laces is a prominent complaint around here. Makes me wonder if lawyers in other fields also don't know what they're doing...

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
