My husband filed I-130 to Nebraska center on April 28. But we haven't received NOA1 yet... why it takes so long? and the check hasn't been cleared either.

I see most member here get their receipt just in 10 days....

Do I need to call the center?

I am getting worried that we are so unlucky right from the begining..... :(

April 28 2007 sent I-130 to NVC

May 22 2007 application transfered to CSC

July 11 2007 received NOA1, decide to apply CR1 instead of K3

Aug 14 2007 touched (not sure if it is touched before Aug 14)

Aug 21 2007 NOA2 in snail mail :)

Aug 27 2007 NVC received our case, number is assigned.

Sep 11 2007 DS3032 and AOS bill generated and mailed out

Sep 12 2007 mailed out DS3032 from Canada and hubby mailed AOS bill in US. DS3032 will arrive NVC 3 days slower than AOS bill.

Sep 18 2007 Auto msg says NVC received DS3032, didn't mention AOS bill yet.

Sep 24 2007 IV fee bill generated

Oct 8 received IV fee bill. Still waiting for 864form

Oct 13 received 864form letter. It was issued on Sep 24 at NVC. Mailed out 864 on Oct 15

NVC agent said they don't receive IV fee bill nor 864. Send out IV fee bill again end of Oct.

Nov 8 IV fee bill entered to system

Nov 12 DS230 generated. But agent still said 864 is not received yet.

Nov 20 resend out 864 again(Hubby forgot to write case number on documents last time)

Nov 27 NVC Auto message said received 864, now waiting for 230

Nov 29 230 delivered. Will arrive at NVC next day.

Dec 3 NVC received 230 and put into its system

Dec 13 NVC operator told us the case is in administrative process.

Dec 14 Called operator again, and magically the case is completed!

Don't worry, I think you're still ok. The dates people post are the date that's written on the NOA1 which is about 1 week before you physically receive the paper notice. So 10 days is really more like 17. Once the check clears get the case number off the back from the image online, then you can check your status off the uscis website.

Whitesnail, Don't worry yet. NOA1 for I130 have been slow lately. There were a few of us that had this problem from April. It took 24 days for my check to be cashed, and 26 days before I received the actualy NOA1 in the mail. I remember other members who waited in the range of 20+ days recently.

I called the customer service line at 23 days, and they said that NOA1s for I130s can take up to 45 days these days. There is a big slowdown. Be patient, it will come.

There are several of us who filed in April that have not had there checks cashed. I called at 21 days and was also told that it can take up to 45 days. At 30 days you can request action to find out why nothing has been done, but that can take up to 30 days.

Patience is a virtue, but it is difficult without knowing anything.

I sent mine late last month too. . . I have a lawyer helping me and I called him right after I got married in march. . . . i don't understand why I am waiting a total of 2 months for a 797 receipt (now projected to be 3 months). I was bothering my lawyer a lot until I called the USCIS and they told me that this month has a backlog due to the amount of people filing. They told me 45 days too yesterday when I called them.

* hey! I am supposed to file with the NSC but, my lawyer from California filed with the California one. . . will this make things take even longer for me?! Or will they treat it the same? I am hoping I don't wait 45 days and then, get it back to file with the correct center. I live in Seattle! You guys already know how stressed I am.

* on a side note, If my lawyer had filed in March, I would not be in this boat.

* My wife got mugged there while I waited for paperwork here. Is that just?!

I appreciate any comments to my situation . . this is my first post. :o)

Yep, the recording says 4 weeks, if you call after 4 weeks and talk to a live person because it has been more than 4 weeks, they will tell you 45 days like the rest of us. I was really nervous too that it was taking so long, and it seemed everyone on VJ was getting their NOA1 so quickly, and there were only a handful of us discussing this delay in the last 2 and half weeks. I asked people that I knew who had done this before and the longest I heard was 8 days. But, we all just filed at the wrong time and ran into this huge backlog for NOA1s.

it better!

i can't believe this backlog

so much for efficiency, eh?

:sigh:

i wonder if USCIS is aware that their processing timeline is directly proportional to the time we spend waiting til we are reunited with our partners

and not everyone can afford the luxury of a frequent flight out of united states

As I posted elsewhere recently, I just got my NOA1 yesterday (May 21) which is almost 1 month after they RECEIVED my I130 at TSC. CSC apparently received my package May 17 (according to my case status online), and they were the ones that sent the NOA1 of course, since TSC is not processing I130's or I129F's. In other words, for those of us that need to send stuff to TSC rather than CSC, that's at least 2-3 weeks more of a delay to our timelines due to TSC forwarding cases to CSC. What's up with that?

I wonder if at TSC they do some sort of pre-processing of the I130, so that when it arrives to the CSC all they have to do is send the NOA1 so quickly (NOA1 in mail took two business days from CSC to my house).

Oh well. For those of you who haven't waited for more than 30 days, I wouldn't be worrying so soon.

OK! I finally have an update. . . i called the USCIS and I got a guy that told me that he can not even check anything for me unless it was 45 days after. . . .

So, i called back and told them that i sent it in 45 days ago. I fianlly got someone and they tracked my I-130 and gave me my WAC number that has been cleared on the 16th of may! if I could have talked to someone earlier 2 weeks ago, I would have gotten my number. . . I don't understand why they can't just look it up for us.

She told me to expect the confirmation in my mail in 2 weeks. . . do they understand that every day matters to us?

So, bottom line, I finally got my number and I am sending in my I-129F today. Gees. But good news!

Thanks
