Hi folks, I would like to ask the question about the police certificate. 

 

The background is as follows:

F2A: PD Feb 01, 2017

Today I got the police certificate in the country (other than my home country which is China) where I am working now. The certificate is valid for 6 months from the date of issuance. And at the end of September I will leave for the States to work (status by then H-1B). I obtained my police certificate in China (valid for one year) last Nov. since then I haven't return yet.

 

My questions are:

1) Is it okay that the police certificate from my current country of residence does not cover the entire period of residence? There is a gap of a couple of weeks since I asked for it now not the very day I leave for the States. I saw on immhelp it says the record should reflect the entire period of stay. 

2) Do I need to obtain an up to date police certificate in China at the time of my consular interview? 

 

On the NVC site it has this statement below:

Important: Police certificates expire after one year, unless the certificate was issued from your country of previous residence and you have not returned there since the police certificate was issued. If at the time of your interview the following three items are all true, you must bring a new police certificate to your visa interview:

  • You are more than 16 years old;
  • The police certificate submitted to NVC was obtained more than one year ago; and
  • You still live in the country that issued the certificate.

 

Then I am a bit puzzled. First, how to define "live in the country"? I certainly have to go back to China for consular processing but I will be indeed living in the States not China. So the 3rd item seemingly does not apply to me. Does that mean I don't have to bring a new police certification at my visa interview?

Timeline

I believe the "live in the country" rule applied to you if you're still in China. The same thing as obtaining a certificate from your home country if you still live there. It's valid for a year. Obviously, if you're living from China there is no way to obtain it on the same day you leave

Sorry I didn’t make it clear. I’m currently living in Europe and will leave and enter US in about two weeks. The last entrance to and exit from China was in Nov 2017. Since then I haven’t returned to China but remain in Europe. 

 

I won’t  return to China until the time of interview. Actually I’m more concerned about the police certificate that I obtained TODAY. I will leave Europe for good so I’m wondering if it is okay to use this police certificate that was issued today not some other date after I have had left this country?

Sorry, misunderstood you! Same thing with año country, just r place China in my post with any other name hahha

 

so I have my certificate from my home country where I live right now and I got it 2 months ago. And there’s no way to process it on the day of departure anyway. It’s valid for one year since issuance. You don’t need to worry about it for sure. They would never make a rule that’s impossible to comply with. If you left a country and never returned, the certificate would have to cover the entire stay. If you still are in the country at the moment of obtaining it, should be fine for 1 year
