i went to the Embassy on the 17 August 2018. Most of the questions was about my previous marriage (k3).the co asked me what happened to my previous petition I told him my previous visa was revoked due to my wife passed away. He asked me how old was my late wife I told him he asked me few questions about my fiance I got all the questions he asked me about my fiance. He asked me of my age I told him. He asked me that after my late wife passed away haven't I married since then I said yes that I just newly engaged with my new fiancé. He said OK he gave me back my passport and gave me a white paper that is written administrative process. he said he will get back to me next week and when I read the paper its says if i don't hear from them after 90 days that I should email them. I don't know if anyone has experience my kind of situation before. When my previous wife died I filled a widowed petition so that they can reinstate my petition but at the I couldn't make it because they asked me to present my late wife late husband death certificate which I couldn't get then. In 2013 I process a b1/b2 visa which I was denied. So this time around my k1 was placed under AP. All my documents are intact there is no any fake documents I have ever used for my visa process before. I have my late wife all the necessary documents. So please if anyone could share his or her experience in this forum so it can be of help for others thanks.

You just have to wait for the embassy to complete their investigation. Your previous application for a B1/B2, is been carefully scrutinized. I don't think you have anything to be worried about if every document is above board, they will get back to you. 

 

Remember to send them an email, if after 90 days you don't hear back.

Every K-1 case goes through some AP.

In your case, it sounds like AP is about the past application and/or evidence of a bona fide relationship and/or verification of documents. Nobody knows for sure what they are investigating, but all you can do is wait.

Many people come out of AP for the reasons noted above with approvals. Some come out with a refusal. It really depends on the result of the investigations and the decision of the CO.

Engagement is regarded as marriage according to US Embassy in Nigeria (Nigerian Culture applies).It could be that ,the petitioner would need file spouse visa for you.

Did you ever state in your B1/B2 application that you were a widow.if you have the copy cross check things.AP can be short or long,it can require more documents or a final decision can be made outrightly.

Nevertheless, Migration to the USA is a waiting game, get busy with other things, to while away the time

Engagement is never a marriage with any country. However, certain cultural rituals/ceremonies, especially with certain countries such as Nigeria, can be considered marriage, or at least "too married" for a K-1.

Engagement and traditional marriage are two different things. I didn't had any traditional marriage with my fiance we where engaged and it didn't involved any dowry. We had a get together with families and friends. In my b/b2 Application form I filled widowed in my form and I have all the documents that back me up as a widowed. When my wife passed away I wrote to the records in the united to let them know I'm the husband to the deceased and before all her documents was given to me they asked me some proof I sent all the proof to them and they where all verified that was why they sent me her birth, death and our marriage certificate. So all my documents are authentic. even after the records confirmation they contacted my late wife families to testify if I'm not their late sister's husband which they confirmed too. So all her estates is still under my care. I filled a widowed Petition i360 which the USCIS gave me 2 years to provide all the necessary documents of my late wife so that my revoked visa could be reinstated I provided all the documents except one which I could not provided which was her previous late husband death certificate. That was why my visa couldn't reinstated so I forgot about it and move on with my life. My b1/b2 was in 2013 my uncle was inviting me for a program in the united states. All what filled in my application are all intact. Then I was working with a company now I have established my own investment I don't do anything dubious they can go ahead with their underground checks. I'm not a criminal nor fraud star in my country. I live in one place for 13 years now I don't have a criminal record in my life.

You are right my Brother I'm busy with my job one cannot put all his mind on visa issues so that one won't get heart attack. My previous visa I was placed on AP for 9 months my Visa was still approved unfortunately my wife died on a car crash that was why my visa was revoked. I don't believed in age difference I believed in love. my late wife died at the age of 64 and I was 34 then my visa was approved. My fiance is 59 and I'm 45 what I believe is love. Their AP doesn't stop me of not marrying my fiance. If they denied me of not coming to America they didn't deny me of not marrying my fiance. Their AP doesn't stop my fiance of not coming to visit me in Lagos. I can never call them to know the status of my case instead I will invite my fiance to come and spend some time with me here. My fiance is in love with me she can settle down with me here and be visiting America anytime she likes. We love ourselves so much. These of you that is in the same shoes with me should not loose courage of loving your fiancé. Put AP under your foot and face your fiance or your spouse.. America is not heaven make your fiance or your spouse your heaven. to me I don't care what the outcome of my AP will be I know I'm not a criminal.. I love my fiance.

First of all I will say God bless the founder of this forum called visa journey.. This forum have given me a lot of courage, when I read some cases here I see some cases that are even worse than my case and still got approved at the end. I love this forum so much, this forum will will give you hope and make you feel strong to withstand your cases. So my fellow 221g members all over the world never you loose hope. What is for you is still for you but it might only take sometimes to come back to you. Any part of the world you come from just be strong and be happy and keeps the flag flying with you and your fiance or your spouse.

Remember I said after my interview which was on the 17 August 2018, the CO gave me a 221g form said he will get back to me next week. For the first time I went to my Ceac status just now today been Sunday.. I saw the head line "Ready".

Hello house I went for my interview on the 17 Aug 2018. I was placed on AP on the 23 Aug 2018 my case status went to "ready". Today been 5 Sept my case status still stuck in "ready". Only last update was changed. Pls is this a good sign or bad sign

Hello house I went for my k1 interview on the 17th of August. After the interview the CO gave me back my passport and didn't look at any of my documents though he asked me how do we communicate I told him through fb chats he said let him see I brought out thousands of fb chat he looked at it he said OK. Then he gave me a 221g letter said he will get back to me next week.

Most of the questions he asked me was about my previous petition (about my late wife). My late wife was an American citizen she died on the process of me coming over. My visa was revoked after she passed away. All the questions the CO asked me about my fiance I got everything concerning my late wife I got every question but I failed the age part. The CO asked me age of my new fiance I told him he asked me my age I told him and he asked me age of my late wife I told him her age as of when we got married instead of her age as of death. But I don't know if that will affect my AP. I have applied for a tourist visa before in 2013 but was refused the CO didn't asked me about the tourist visa he was just asking me about my past marriage which I told him everything. All my documents are intact and original infact I never used anything fake or suspicious to attach for my documents. I have all my late wife documents. Please advice me if the wrong age I gave them about my late wife will affect me but it was not a wrong date it was the date in our marriage certificate. The she was 40yrs and she died at the age of 44yrs so I told the co 40 yes when he asked me how old was my late wife. after my AP which was on the 17 of Aug. On the 23 of August my case status update was "Ready" I check it yesterday and the case last update change to 5th of sept was still "ready" can I have any contributions...

I don't see the age question being the main concern of the CO.

 

CO seems more concerned over the timeline of your first marriage and then subsequently applying for the K1 visa after your first wife passed away.  If it's not been long inbetween, might have raised some suspicion of the validity of your new relationship.

 

Some can be in AP for weeks/months.  No way to know for certain how long it will take.

My wife died in Nov 2008. My visa was revoked in Feb 2009. I wrote to US govt to let them know i am the husband to my late wife to make sure I hold her death certificate with all of her documents. They replied me and asked me to send some prove before they can release any of her documents which I did through an immigration lawyer in the US. after they I sent all what they requested all her documents was sent to me. Later my attorney advised me to file a widowed petition which I did. The USCIS gave me two years to present all the necessary documents which I did at the end I couldn't present one document which was her previous husband death certificate. That was how I lost the widower petition. In 2012 I met a new Friend online in 2016 we became closer and closer which I proposed to her she agreed to marry me we plan for engagement in 2017 which she visited me in my country and we did engagement she spent two weeks with me in my country she left back to US to file a k1 petition. Our engagement was in April. She came for the second time in Nov. Which she spent another two weeks with me. All her visit was in my house we never lodge in any hotel. I have live in my apt for 13 years now even my late wife that was where she lived then when she visited me. She visited me twice as well.
