Do you mean if the marriage that happened in USA but it is not valid in some other countries, USA will also consider it not valid even if it happened in USA?! The marriage also was authenticated in the department of states in USA and in the SA embassy in DC and in the ministry of foreign affairs in SA but it was not recognized in the ministry of interior in SA because of his religion. Just to clear things up to you. If u have another question I'm ready to answer to clear things up more cuz u seem so confused!!!!

All USCIS will care about is that you were legally married.  You got legally married in the US--- you did not commit any crime in the eyes of the US (doesn't matter whether or not it was a crime in your home country).

When you apply for a regular CR1 they do check that it is a rela marriage and not one for Immigration benefits.

Any member is able to see all posts on a thread and reply to them. :) 

 

I was just reiterating that it's a legal marriage in the eyes of US law (you were married in the US), no matter what SA thinks regarding religious differences when marrying.  Whether it's a *bonafide* marriage in the eyes of immigration is up to scrutiny by USCIS (which is what Boiler refers to above).

I presume the I-130 was submitted with evidence that shows the marriage was bona fide. The visa interview is an important opportunity to establish that your marriage was authentic: https://www.boundless.com/immigration-resources/how-do-we-prove-our-marriage-is-real/

Yes I know about that. The bona fide marriage evidences is already included in the k3 visa application my husband applied for me. I'm actually qualified for IR1 visa not CR1 visa cuz we got married in 2016 so its been more than 2 years in our marriage nd we have n 18 months baby girl. But my husband wanted me to be there earlier so he applied for k3 visa not IR1 visa and he also included an expedite letter but I checked the USCIS website, but there is no response yet about the expedite letter. Now the expedite request  doesn't matter I guess cuz the application will be converted to widow visa and I'm not in danger anymore cuz I'm in Netherlands not SA but IDK how long widow visa takes. Hopefully not that long. They also asked me for bona fide marriage evidences before the us embassy in SA issued my daughter CRBA and a US passport. They aalso asked ME for fide marriage evidences when.my husband was authenticating our marriage certificate in the ddepartment of state and in the SA embassy in DC. We went through so many bona fide marriage evidence questions in the last 2 years when we had to do some paperwok.

Yes the I 130 package was so completed with all the evidences of bona fide marriage. I'm sure about that because we have a lawyer and before he mailed the packages he asked us about so many things to send him so we don't get RFE that delays the process.

I will also keep collecting more evidences for my interview like when he was in the hospital, when I.talked to his doctor and the funeral home. The FB pages of us, my conversations to.his family and friends about his daughter and how they miss her andso want to.see her cuz she.reminds them.of my late husband, about his medical decision and funeral decision. I have so many more things I need to show the officer in the interview time.

I will make an info pass appointment in Netherlands in this week and update them for everything but the problem cuz I applied for asylum here, they took my passport and my daughter passport as they do.for all refugees. They only give it back to me after the next interview and when they decide they give me an asylum or not. Idk if that would be a problem to the us embassy cuz I'm.trying to go with my daughter and I have to show them her us passport and my passport but I dnot have them!!!

Sorry for your loss.

 

There is no "Trump Separation Policy", and certainly no immigration process that would separate a single mother and daughter who are legal immigrants. Make sure you have a copy of your husband's death certificate so you fly without issue.

 

I was a bit unclear on your daughter..is she the biological/adopted daughter or step-daughter of your late husband?

My lawyer said it will automatically be converted to a widow visa. And USCIS will notify me that they reopened my case and converted it to an i37060. I'm just wondering, does he mean they will first approve the I 130 and the I 129f in the same service center which is potomac service center then it will be converted to an I 360, or they will reopen the application and then convert it an I 360, then they transfer it to another service center ( because I 360 applications are only getting processed in California, Vermont and Nebraska centers, not in potomac) then will itittake take that  long process time maybe longer than the original application my late husband already applied.  Cuz I 360 processing time is very long, from 14 to 20 months 😰!!!!! Im So confused because when I checked the process time of I 360, i didn't see potomac service center that is processing my current application, the k3 visa spouse. Do u think potomac will only just keep processing it as its I 360 with that long processing times, or as its a k3 visa with 5to8 months.processing times?  Afraid they start over and it takes one more year!!!

Has USCIS been notified of the death of the petitioner yet? No automatic change from an I-130 to an I-360 will take place until that happens.
