I’m trying to extend my Temp Visitor expiry date on my NY license using my I797C NOA which extends my EAD for 180 days. 

 

EAD  and temp visitor date expire Sept 21 2018. My NOA is dated Aug 20 2018. 

 

Since my local office is small, they fax it to the regional office in Albany where it’s looked over by the one person who does the  the immigration based DMV paperwork. She ran my paperwork  in their software and it said that USCIS does not recognize the 180 day extension and that I need to come back AFTER my license expires.  

When researching this in the past I have been explicitly told  that I must renew BEFORE before it expires and that by showing my 180 day extension NOA I will have it extended.  I cannot legally drive starting Sept 21. 

 

Is this a DMV issue or is this a USCIS issue?

It’s my THIRD day at DMV trying to sort this out and I’m going to lose my mind.
