Why is none of this easy. Anyways I hope this is the correct spot. Went today to get Social Security numbers for the fiance and her 17 year old son. Waited for 2 hours and had to leave to go to work which is right around the corner. As soon as I left the line sped up and they were called. The guy behind the glass told them that she needs to wait about 30 days and immigration will send her the number. Told the son he should have gotten a I-766 when he went through immigration. From everything I have read this is incorrect but I was not there. He told the fiance that her son was eligible to work once he got the I-776.

 

My one question is can he work? the papers I have say a K-2 minor is ineligible to work. Is that till he turns 18 or 21?

Go to another SSA office. I have a feeling this guy didn’t know about the visa type. It really depends on person unfortunately.

The k2 will only be able to get a ssn with ead in hand. And he would only be able to work with the ead anyway, ssn alone would not be enough.

Your fiancé should be able to get one if her i94 is still valid and within at least 14 days of expiration.

If you go to th ss fórum there should be a guide on what to do. If one office gives your trouble, just go to another one

Which parts of the guide do you find confusing?  

 

Your fiancée brings her passport + form I-94 (+ birth certificate) to the SSA office and applies for a card.  She can also bring a completed SS-5 form although that's not strictly necessary, but it might be helpful, especially if she's not fluent in English or if she's not that familiar with the SSN & K-1 regulations.  With some luck she'll encounter a more competent SSA officer next time.  

 

Her son isn't eligible for a SSN just yet, so I'd not apply for a SSN for him at this time as that would only help to confuse the SSA officer.
