Hello. I'm an American living in France and am married to a French native. We're moving to the states in November but I'm trying to get the paperwork for her immigration started from here.

Can anybody confirm the fee schedules below? It contradicts what I'm seeing on US government websites, which only refer to the schedule on the left (applicant living in the US), not the one on the right (applicant living abroad) The source is recent, from a business that specializes in this stuff (boundless dot com).

Thanks very much for any insights or advice about this and the process in general, I really appreciate it.

Woah.. you didnt even start the spouse visa process but you want to move in November?

I hope you mean November 2019 because i130 process takes about 12 to 14 months to complete.

Just follow the i130 guide from VJ.

Thanks for your reply, Roel. It was a very recent decision to leave France so applying earlier wasn't possible. She'll be on a tourist visa.

She cant move to the US on tourist visa. If she's planning on moving to the US and adjusting status then she'll commit an immigration fraud.

USCIS doesnt care that you suddenly decided to move. You need to file i130 for your spouse and she will not move anywhere until its approved.

Any further questions about using b2 visa for immigration purposes will result in this thread being closed. It's against the rules to support a fraud.

The column on the left appears to show the costs for an adjustment of status, which is when someone is already living in the US and adjusting to a marriage based status. Your wife is not eligible to go this route because she is not already lawfully living in the US. Make sure that tourist visa is truly used for visits, and she should be prepared for some more scrutiny at POE because of this.

Since your wife lives in France, the column on the right is what you'll fall into. Those costs line up perfectly with what I've spent (of course the medical varies by country/clinic, so that's the only one that won't be exact).

Thanks, shumway1756 !

Roel, as I said before we're aware that she'll have to return to France until it's legal to return as an immigrant. It's legal for her to accompany me to the US, as a visitor, with an ESTA. I appreciate your concern but just want to be clear about that.

It is legal to visit during the process.  There is an entire "pinned" thread about doing so.  Note that there is no guarantee of entry with ANY visa.  Each entry is a judgment call.
