Urgent: New police certificate requirement!!!

Timeline

Vancouverites: Has anyone gotten this through their local VPD? My fiancee made the trek to North Vancouver RCMP and was told she needed to go to her local office.

 

The local office had no idea what to provide her with, so she went with the Privacy Act. However, now my concern is that because she went to VPD, that it will not go through "RCMP National Repository entire holdings" as my lawyer directed. She also did not have to fill out a form, it was a verbal request. My worry is growing, as my lawyer also indicated that there should have been a form for making the request..

Update: My lawyer insists it needs to be Certified, go through RCMP, and be Privacy Act, to be accepted.  

 

RCMP: You're not a North Van resident, so you need to go to VPD

VPD: There is no Certified Criminal Check that falls under Privacy Act. Pick one or the other. 

 

So at this point, we've applied for a non-certified privacy act check through VPD, which  may or may not go through RCMP? I've emailed Commissionaires to confirm that what my lawyer is requesting is correct, and if they can do it..

For me they just accepted the name check. All though I was prepared with the privacy act one and the border and visa version as well.

Commissionairies is probably your better bet even if it ends up costing more. Apparently you might want to give the Surrey branch a call - earlier in the thread, it was mentioned that they know exactly what's needed for US immigration. From what I was also reading, the privacy act check is non-certified. The wording on the state website is apparently wrong.

My fiance went to commisionares in Surrey and got CCRC for visa and Privacy Act record check. They knew exactly what both of them were

Had my interview today. Provided Privacy Act and the Name check only and got approved. :)

Removing Conditions timeline:

  • I-90 accidentally submitted - 2020-08-14
  • I-751 submitted & received - 2021-03-26
  • Biometrics applied to case - 2021-04-21
  • Ready to schedule interview - 2021-12-22
  • Interview scheduled - 2022-01-04
  • Interview - 2022-02-01 / Postponed
  • New 10 year card being sent out!!!!

The woman I spoke to at EPS today indicated that technically the Privacy Act check is not a certified criminal record check.  She was, however, very familiar with this being the new requirement for US immigration and spoke at length about it.  I also did not fill out a form.  We confirmed my name/DOB, I had a photo taken, I was fingerprinted electronically, and I wandered on out of there.

 

I wouldn't be overly concerned if you asked for a criminal record check under the Privacy Act and had fingerprints taken.  Odds are pretty good it's the right one.

Fingerprints are taken for the privacy act but do not appear on the police certificate itself.

With great relief, I was approved today for my IR1 visa. Will write a much longer review, but wrt privacy act check and those missing it, here's my experience: there's two people you speak with when you're inside the embassy. First person takes your documents, second asks you the interview questions. The first person I spoke with, once we got to police certificate part, asked me if I had another police certificate. I explained my situation (cc way before new privacy act requirements came into place), showed the receipt that I had already done it in Montreal but that the results hadn't arrived yet, and she made me very nervous by saying the interviewer would decide if I needed to send the embassy the new certificate. When I spoke with the interviewer, she didn't even bat an eye at the old name check only police certificate and approved me within 5 minutes. Ymmv, might vary on which interviewer you get, but I seemed to have lucked out and gotten grandfathered in months after the change in requirements took place. Best of luck to the rest of you.

Did they say if you needed both? I'm getting the impression that the non-certified Privacy Act is all we need for the K-1, but because I'm concerned it's VPD and not RCMP, we're planning to go to Surrey to get the CRCC.

They didn't say anything to her in regards to whats needed for the interview. I told her to get both just so we have them both for the interview just so we are fully prepared

Wow - really glad I found this thread!

 

I just got my name-only police check in the mail today and I was feeling so great about it being the LAST thing I needed....

 

My interview isn’t until January, but with the holiday season fast approaching, I have to get on this NOW.  I hope my small town PD can handle this request ugh 

 

Please keep sharing your experiences with this situation at the consulate.

Update: Went to Commissionaires in Surrey. Confirmed that Privacy Act check (even from VPD) goes through RCMP, and IS NOT a certified check. They also did mention that there are several different kinds of Privacy Act checks, though they seem to know what they're doing. I'm pretty sure we got the right one from VPD, but we decided to get one through Commissionaires as well just in case and I'm glad we did; unlike VPD, we got a printed receipt of the request with her actual fingerprints as well as some other information. VPD had given us nothing.
