Just wanted to provide a clarification that I obtained from NVC today regarding the RCMP certified criminal check.  Their website states that fingerprints must be shown on the document, however per their September 10, 2018 update requiring the check be requested under the Canadian Privacy Act the document you receive does not have fingerprints shown.

I spoke to a NVC rep and supervisor today and they confirmed that the document they use for comparison and approval does NOT have fingerprints on it.  They are looking into this on their end and updating things accordingly.  Please continue to use the September 10, 2018 update/comments when requesting the certified criminal check.

I just checked their website, it says "does not include fingerprint". But mine was rejected because it does not display fingerprint...

Well this is frustrating.  Did you request the record that includes "RCMP National Repository entire holdings" ?  I just submitted all my documents and only included the non-fingerprint version of this report, but as directed by the NVC customer service rep included a letter detailing my phone conversation requesting for clarification.  So I guess we'll see...

Yes, I did the entire holdings. I just spoke with an NVC Rep and got the same response as yours. It would take up to 6 weeks for the supervisor to respond. This is ridiculous.

After being rejected by sending a Crossing Boarder one, I sent the Privacy Act one (without fingerprint) to NVC. Unfortunately, it was REJECTED again because " 10 - Canada Police Certificate - The certificate does not display the applicant's fingerprints." I then checked the Department of State website, it clearly states "The Certified Criminal Record Check requested under the Privacy Act is fingerprint-based, but the report does not include an image of the applicant’s fingerprints."  What the hell??? I'm calling NVC to figure it out

The problem is that there really is nobody to get a hold of to clarify the mistakes they have on their website.  I'm sure that many people have called, emailed etc... and told them of this problem and it's been over 7 weeks since we first learned of the new requirements for the certificate but the misinformation is still up on their website and still causing a lot of problems and delays for people.

I'm just wondering when did they change the website to the current requirement which is "does not include fingerprints". The letter I received today was dated Oct. 23. It gives me a feeling that they changed after that date.

Ya you are probably right.  Not everyone at the NVC is aware of it i guess.

The conversation I had with them was on October 23rd.  When I checked the site yesterday, the 24th, the information had not been updated.  Today though after seeing your post, I checked and saw that it had been updated to state "does not include fingerprints" in bold letters.

This is all on the NVC in my opinion - and anyone being rejected should be calling and complaining.  I would imagine others before me had noticed the same conflicting information as I did.  It is nice to know that since speaking to them about this on Tuesday they have at least corrected their website, now if only those working within the office could get on the same page.

I would suggest you call them again and perhaps even explain this thread, and information that we've all learned as of late

As far as I know, this was added after the 17th of October

"Special Seal(s) / Color / Format: The Certified Criminal Record Check requested under the Privacy Act is fingerprint-based, but the report does not include an image of the applicant’s fingerprints."

Hello. Apologies if I am writing this is in the wrong thread. Reading this comments are confusing still. Can someone explain to me what exactly is needed?

Police check with Privacy Act (which does not include the fingerprints)

Or Police check without the privacy act (does not include fingerprints)

Also I haven't yet received the NOA2. I am expecting it to recieve early December. Would I be getting the police certificate too soon if I go for fingerprinting this week? thanks

There is still a bit of confusion as to what is being accepted, but on the website, it still does state that you need to get the Privacy Act fingerprint check.  It has been fixed to say that it will not have the actual fingerprints on it when you receive it back, so i'm going to assume that that is what is needed.  I think a lot of the confusion came when they had originally had on their website that it must have the fingerprints on it, when it really didn't.  I think that by now, close to 2 months later, that all the people that are checking our documents have been informed on the proper certificate needed.  Least i hope so for everyone's sake.  What a mess we all had to go through at the beginning of this Sept 10th change, sheesh.

Pretty sure that the certificate is good for a year unless you get in some kind of trouble with the law and then you will need a new one, but you should be fine with getting it now.

I would encourage you to email the consulate and ask if this applied to folks who will submit the police certificate to NVC before 10 September AND/OR to the people who will interview before 10 September?

It will be a great help for the rest of us. I am going to be calling NVC tomorrow, and see if they give a meaningful answer.

Hi Darth and company!

we’ve got our interview in Montreal for Ir1/cr1 visa Nov 27th! Hooray. And we were documentarily qualified when the case closed (cc) more than 2montgs ago.

How do I figure out if the new police requirements pertain to us?

I thought they they would have rejected our initial police clearance from the regular police station if it wasn’t good enough????

thanks for helping!

Hey there,

My interview is also Nov. 27! I am bringing both police checks just to be sure. I was documentarily qualified with just the Name search but I got the Privacy Act and my fingerprints done as well. I figure better safe than sorry! :)

As far as I know, there is no for sure way to find out what actually pertains to us, so make sure you're over prepared rather than under.

FYI: my husband had his interview yesterday and they took BOTH of the police checks from him. I am not sure if BOTH are required but from what he told me he said they were pleased he had both of them old and new.

Hello everyone! Let me tell you what i've learned.

The TWO police checks at issue are:

1) RCMP certified criminal records check with fingerprints - this is for people who HAVE A CRIMINAL RECORD and/or that were pardoned and have applied for for an immigration benefit. This is when they (RCMP/Commissionaires) select "for visa/immigration purposes". The outcome mailed to you DOES HAVE your fingerprint visible on the form. This form is sealed with RCMP certified insignia. The problem arose when you are asking RCMP to run certified criminal records check with fingerprints checks on people without criminal records and have those handed over to USA officials as i gather that is against our current privacy laws and RCMP policy.

2) RCMP non certified criminal records check with fingerprints- this is for people who DO NOT HAVE A CRIMINAL RECORD and have applied for for an immigration benefit. This is when they (RCMP/Commissionaires) select "Privacy check" under the privacy act/Canadian law. The outcome mailed to you DOES NOT HAVE your fingerprint visible on the form due to Canadian privacy laws but your fingerprints have been checked against their biometrics databases. This form is not sealed with RCMP certified insignia. THIS is the form that will be required for k1 visa's.

I got both because by the time i unraveled all the facts i had already ordered the certified with fingerprints visible. I have now ordered another via the commissionaires via "privacy check".

Hope this helps with this discussion.
