I like your style lol, we will probably do the same unless we see concrete evidence that privacy act alone gets rejected at interview :)

May the odds be ever in our favor 😁

I just stumbled across this forum, I am a k1 visa applicant.

what exactly did you guys ask for when you went to get this done? I read this whole forum and am still a bit confused.

Am I asking for both certified (for visa/immigration purposes) and non certified criminal background checks under the privacy act with the RCMP?

I don’t mind paying the extra I assume as a k1 it might be easier cause we just bring everything with us id rather be overly prepared.

Yes I would still get both the certified criminal record check with fingerprints that states for immigrations purposes and the Privacy Act criminal record check. I got my certified criminal record check through Gambit ID and then I went to the Commissionaires in Toronto to get my Privacy Act check done. (Although you could probably get both through the Commissionaires) The certified check took a couple of weeks to get and the Privacy Act took 9 days to get.

Also just a note here, that person is going through a different Visa process. If I'm reading correctly, their police cert was rejected at NVC stage not at the interview stage where you submitted yours. @LLabout is that correct?

Good point...sorry I didn't read more carefully!

I think changing the requirements is stupid.

But honestly people have had zero issues with just the regular police check with fingerprints so if you are only going to get one, get that one.

So, still confused (but now in a different way) because I wasn't aware that there was a regular police check with fingerprints..? I thought that any check with fingerprints has to be mailed out to Ottawa (or sent electronically if it is through the Commissionaires/Morpho) to be processed through the RCMP? (i.e., the only finger print checks that are in question for our purposes are the Visa/border crossing request category, or the privacy act request category one)

All this talk makes me wonder a little bit whether they even know what they're supposed to be getting, at the consulate/NVC, and if they're all in agreement on what they're accepting or not.

No, you are correct! I got my fingerprints done at my local police station then mailed them to Gambit ID and they sent the request to the RCMP. I then chose to have the RCMP send the check back to Gambit ID then to me (sorry if this confusing lol!). That was for the "visa/border crossing..etc"... I just happened to the in Toronto then went to the Commissionaires and got the Privacy Act check done then it was sent directly to me from the RCMP.

It seems like all different police checks are being accepted, so it's frustrating. I have my interview Wednesday I will only give them the Privacy Act one first and see what they say.

Yeah - it seems like a real mess! Maybe the NVC and Canada consulates are feuding 🤣. I just keep picturing some angry officer updating the reciprocity page in CAPSLOCK because they were so sick of NVC sending folks with wrong certs but then no one actually updated NVC lol

The fact that the immigration website still hasn’t cleared this up and it’s been over a month is actually deplorable.

You can get the fingerprint certified check, which does not HAVE to be through the commissionaires, just through any local, provincial, or RCMP dept OR private company OR Commissionaires.

Seems like the NVC wants the certified and Montreal itself doesn't care if you have the name check, fingerprint check, or privacy act.

No it's really normal for the US government to have no idea what it really wants or to update its websites appropriately.

Everyone is getting everything and submitting everything so how are they do know that their website is wrong when they get what they want in the end?

I guess we’ll have to wait and see. Not enough people have really given feedback on just the privacy act yet to determine if it’s accepted by NVC on its own. But having to get both documents just to “cover your bases” is unacceptable. There should be precise clarity just like any other country’s Police certificate.

Mine done under the Privacy Act got rejected.  The Visa Border Crossing Certificate (with the fingerprints on the form) got approved.  I submitted both to be safe and it worked.

Did you submit them together back to back or did you submit one in the additional documents section?
