My fiancee first visited me for a month this past May 28 to June 29. We submitted our application for the petition for alien fiance and it was received July 19. My fiancee plans to come to visit me in again September 13 and stay for about 3 months until December 4. Would staying that long that soon after the first visit and during the k1 process be okay? Do you think she could have any problems coming back into the US? Thank you.

As long as she is allowed entry at POE, staying for 3 months will be of no concern as long as the allowed time in the passport at POE is more than 3 months.

She will not have any issues coming back on k1 visa later on but she may or may not face issues travelling this time at POE. It depends on the officer.

Make sure she takes proof of ties to her country (lease, employment letter with date of return, bank statements/ insurance, anything that ties her to her country and is strong evidence she is going to return) and a copy of the K1 packet and NOA1. She must answer all of their questions honestly.

 

It is at the border agents discretion if and for how long they allow her to visit.

 

My fiance comes down every few weeks for a long weekend and has never been asked for anything other than how long he is staying, but they also pretty much know him at this point since hes been driving across the border every month for almost 3 years at this point. They can look at his records and see this is VERY normal for him and he always returns when he says he will. But even with that, he always takes the K1 packet, NOA1 and a letter of employment from his company stating his date of return. just in case.  We know theres always the chance he gets a jerk who says 'no'.

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....
